Nesta obra, o autor busca demonstrar a divergência existente na jurisprudência do Supremo Tribunal Federal, que oscila bastante no tratamento do princípio da reserva legal em matéria tributária. Ora é admitido o tratamento dos aspectos ou critérios da hipótese de incidência tributária por meio de medida provisória, ora o STF impõe um estrito regime de reserva de lei complementar e de lei ordinária para criação ou majoração de tributos. À luz da teoria dos direitos fundamentais, essa oscilação de posicionamento do Supremo Tribunal Federal deve ser solucionada em favor de uma interpretação mais rígida, mais protetiva dos direitos e garantias individuais do cidadão contribuinte, em detrimento do uso da medida provisória pelo Poder Executivo ao se instituir ou majorar tributos. Da mesma maneira, sob o enfoque da doutrina dos precedentes judiciais, as exigências de segurança jurídica exigem uma superação dos precedentes autorizadores do uso da medida provisória em matéria tributária, partindo-se de uma interpretação pautada num "originalismo garantista" do Texto Constitucional.
