This work provides a detailed, substantiated proposal for the legal regulation of this problem. German description: Streiks im Bahn- und Luftverkehr, im Gesundheitswesen und in Kindertagesstatten haben in den letzten Jahren Aufsehen erregt und bei grossen Teilen der Bevolkerung auch Unmut hervorgerufen. Sie unterscheiden sich von normalen Arbeitskampfen dadurch, dass der eigentliche Streikgegner weniger der Arbeitgeber, als vielmehr die Allgemeinheit ist. Diese ist jedoch nicht an der Schlichtung solcher Arbeitskampfe und auch nicht an Gerichtsverfahren uber deren Verhaltnismassigkeit beteiligt. Das Werk fordert daher mit rechtsvergleichenden und verfassungsrechtlichen Argumenten eine gesetzliche Regelung zur Regulierung von Arbeitskampfen in der sogenannten Daseinsvorsorge.

Die Frage, welche Beteiligungsrechte dem Betriebsrat während der Tarifauseinandersetzung zustehen, ist im Schnittfeld von Arbeitskampf- und Betriebsverfassungsrecht angesiedelt. Jansen weist nach, daß eine rechtsfortbildende Angleichung der konkurrierenden Rechtsgebiete erforderlich ist. Diese Angleichung wird mit Hilfe des Paritätsprinzips bewerkstelligt, das auf neuartige Weise konkretisiert wird: Den Ausgangspunkt der Paritätsbewertung bildet die formelle Kampfmittelparität der sozialen Gegenspieler, die durch eine materielle Paritätskontrolle zu ergänzen ist. Danach sind Arbeitskampfmaßnahmen des Arbeitgebers von der betrieblichen Mitbestimmung freizustellen. Dies gilt, wie der Autor umfassend darlegt, nicht nur für die Aussperrung, sondern auch für Maßnahmen im Rahmen einer Weiterproduktionstaktik, mit denen der Arbeitgeber die Fortsetzung der Betriebstätigkeit während eines Streiks anstrebt. Das Problem der Arbeitskampffernwirkungen wird in einem gesonderten Kapitel eingehend untersucht.
