La teoría de la equidad (epieíkeia) de Aristóteles es ese tipo de ideas que atraviesa la historia del pensamiento jurídico y que tiene una indudable incidencia en el quehacer interpretativo judicial. Sin embargo, es susceptible de diversas interpretaciones, resemantizaciones y apropiaciones, incluso por parte de cosmovisiones opuestas. En términos generales, se pueden identificar dos enfoques predominantes en la literatura. Una parte de los autores sostiene que se trata de un criterio extranormativo, en el sentido de que el argumento de equidad va más allá del registro de la ley, a un plano externo que se identifica con un orden metafísico de una justicia o ley naturales. Otra, en cambio, considera que es un recurso de corte intranormativo, en el sentido de que la corrección de la norma involucra ajustar la justicia legal desde su interior. La equidad sería, pues, un principio de racionalidad interno al derecho, que guía el desarrollo práctico de la labor judicial y facilita la aplicación de leyes a casos complejos de acuerdo con los valores político-morales fundamentales del orden constitucional. Siguiendo esta última línea de lectura, este libro se centra en el problema de la discrecionalidad y la libertad judiciales, así como también en los criterios de racionalidad y éticos que guían la labor del juez equitativo. A diferencia de aquellos que ven una fuerte creatividad interpretativa, se argumenta que el juez que practica la equidad tiene la tarea de maximizar el valor de la ley y preservar su integridad. La tesis que se defiende es que los jueces no deben innovar y, de hacerlo, tienen que adherirse lo más posible a la ley existente, respetando un criterio claro y específico: recuperar el sentido de justicia ideado por el legislador, pues allí se encuentra expresada de manera más pura la razón y se definen las condiciones para la realización del fin del régimen político.

The Eudemian Ethics and the De Virtutibus et Vitiis have not received much attention from scholars. Mr. Ross’s suggestions have been of the greatest use to me; Fritzsche’s commentary I have sometimes referred to with advantage, and also to some notes printed by Prof. Henry Jackson and kindly sent me by him some years ago. Prof. Jackson is also the author of an article in the Journal of Philology, xxxii, which has shed a flood of light on the corrupt passage, Bk. VII, chs. 13, 14. Eryxias by Plato is a spurious Socratic dialogue. It is set in the Stoa of Zeus Eleutherios, and features Socrates in conversation with Critias, Eryxias, and Erasistratus (nephew of Phaeax). The dialogue concerns the topic of wealth and virtue. The position of Eryxias that it is good to be materially prosperous is challenged when Critias argues that having money is not always a good thing. Socrates then shows that money has only a conventional value.
