Today the majority of the armed conflicts around the world are fought between States and armed groups, rather than between States. This changed conflict landscape creates an imperative to clarify the obligations of armed groups under international law. While it is generally accepted that armed groups are bound by international humanitarian law, the question of whether they are also bound by human rights law is controversial. This book brings significant new understanding to the question of whether and when armed groups might be bound by human rights law. Its conclusions will benefit international law academics, legal practitioners, and political scientists and anthropologists working on issues related to rebel governance and civil wars. This book addresses the debate on this topic by employing a theoretical, historical, and comparative analysis that spans international humanitarian law, international criminal law, and international human rights law. Embedding these different perspectives in public international law, this book brings several key points of clarification to the legal framework. Firstly, the book draws upon social science literature on armed conflict to present a new viewpoint on the role that human rights law plays vis-à-vis international humanitarian law in non-international armed conflicts. Secondly, the book sheds light on the circumstances in which armed groups acquire obligations under human rights law. It brings illumination to these topics by combining historical and comparative research on belligerency, insurgency, and international humanitarian law with a theoretical analysis of legal personality under international law. In the final part of the book, the author tests the four most utilised theories of how armed groups are bound by human rights law, examining whether armed groups can be bound by virtue of (i) treaty law (ii) control of territory (iii) international criminal law and (iv) customary international law. At the start of the Syrian conflict in 2011, thousands of pro-democracy rebel groups spontaneously formed to fight the Assad regime. Years later, the revolution was unrecognizable as rebel opposition forces had merged into three major groups: Jabhat al-Nusra, Ahrar al Sham, and the Islamic State in Iraq and Syria (ISIS). Why did these three groups rapidly increase in size and military strength while others simply disappeared? What is it about their organizational structure and their Islamist ideology that helped group manage their fighters so successfully? With these questions at the forefront, this book examines the internal organization of armed groups and, in particular, their human resources. Analyzing the growth of these groups through the prism of a labor market theory, this book shows that extreme Islamist groups were able to attract fighters away from more moderate groups because they had better internal organization, took better care of fighters both physically and monetarily, experienced less internal corruption, and effectively used their Islamist ideology to control recruits. This book examines whether differences in the organizational structure of armed groups shape patterns of human rights violations in civil wars. Since the end of World War II, civil wars have been characterized by extremely high numbers of civilian casualties. However, the exact extent of civilian suffering varies across time, conflict, and geographic region. Recently, a new strand of research has emerged, primarily focused on studying the dynamics underlying the variation in civilian abuse by examining the characteristics of the armed groups and how these characteristics influence the armed groups’ behaviour towards the civilian population. With reference to principal-agent theory and data on the organizational structure of more than 70 armed groups active worldwide from 1989 onwards, the author’s analysis functions both on the level of the armed group and on the level of the individual via personal interviews with combatants. Offering a unique insight into how factors such as recruitment methods, hierarchy and organizational commitment may affect the likelihood of civilian abuse by combatants, this book will be of much interest to students of political violence, civil wars, war and conflict studies, security studies and IR in general.

Armed groups operating beyond the state have become the most important actors in most contemporary wars and violent conflicts, from Iraq and Afghanistan to Colombia and Somalia. All groups, however, challenge the state’s Weberian monopoly of the legitimate use of force, yet their origins, evolution, violent dynamics, and relations with state power are poorly understood.
