Somewhat overlooked in this debate has been how mandatory arrest and no-drop prosecution affect abusers, a critical question for understanding the power of criminal punishment to combat intimate partner abuse. In Arresting Abuse, Keith Guzik answers this question. Drawing both from firsthand observations of a police department and a criminal court following mandatory policies and extensive interviews with 30 offenders arrested and prosecuted for domestic violence, Arresting Abuse provides a critical assessment. While mandatory arrest and no-drop prosecution allow the state to extend formal legal supervision over an increasing number of violent men and women, thus seemingly increasing its power over them, offenders prove resistant to change. They see themselves as victims of injustice, continue to view their violence as justified, and devise new strategies to preserve their definition and enactment of self.

In this outstanding new study Don Weatherburn confronts the data, appalling as they are, with his characteristic plain speaking and good sense. No excuses are offered, or simple solutions applied. — Mark Finnane, ARC Australian Professorial Fellow, Griffith University This is a provocative and courageous book by a well-respected criminologist, offering a critique of the over-representation of Indigenous people in custody and of the programs and approaches that are attempting to ameliorate the situation…All Australians owe it to Indigenous Australians to reduce these rates of incarceration. — Dr Maggie Brady, CAEPR, ANU Finally Weatherburn reviews some of the clumsy theorizing that have been at the centre of the debates about the overrepresentation of Indigenous Australians in our criminal justice system since the Royal Commission into Aboriginal Death inCustody in the early 1990s. — Rod Broadhurst, Professor of Criminology at the ANU Despite sweeping reforms by the Keating government following the 1991 Royal Commission into Aboriginal Deaths in Custody, the rate of Indigenous imprisonment has soared. What has gone wrong? In Arresting incarceration, Dr Don Weatherburn charts the events that led to Royal Commission. He also argues that past efforts to reduce the number of Aboriginal Australians in prison have failed to adequately address the underlying causes of Indigenous involvement in violent crime; namely drug and alcohol abuse, child neglect and abuse, poor school performance and unemployment.

This report serves to assess the Nation¿s progress in addressing juvenile crime. The 2007 data bring some welcome news, as the recent trend of modest increases in juvenile arrests in 2005 and 2006 has been broken. The good news is reflected not only in the 2% decline in overall juvenile arrests and the 3% decline in juvenile arrests for violent crimes from 2006 to 2007 but also in the data for most offense categories, for males and females, and for white and minority youth. However, one area that merits continued attention is disproportionate minority contact with the juvenile justice system. For example, the arrest rate for robbery among black juveniles was more than 10 times that for white youth in 2007. Charts and tables.

Since empirical research on domestic violence began in the 1970s, it has become clear that without intervention, significant percentages of domestic violence cases escalate into more serious incidents. However, with the exception of cases resulting in homicides, there are no reliable criminal justice statistics that document the rates of serious domestic violence incidents. What, then, are the most effective means--in terms of safety and cost--of protecting victims? Featuring writings from noted contributors, Do Arrests and Restraining Orders Work? grapples with the markedly different results of research and analyses on the effectiveness of arrests and restraining orders. This probing volume examines the proper role of arrest and the degree to which the criminal justice system can rely on restraining orders to prevent domestic and other kinds of violence. Representing a wide array of research methods, the chapters include a variety of perspectives, including those from police, prosecutors, the judiciary, and probation officers. Timely and provocative, Do Arrests and Restraining Orders Work? asks the challenging questions that will help the criminal justice system move toward effective solutions. This volume is an excellent resource for students as well as researchers and academics in criminology and for a wide array of criminal justice professionals, including police management personnel, attorneys, and policymakers.

In this provocative contribution to the debate on which interventions are most effective in reducing domestic violence, a wide range of research methods and analyses are presented and a number of issues raised. These include: whether the criminal justice response to domestic violence is inadequate; whether there is a conflict of interest between society and the victim of violence; and whether alternative means should be used to deter chronic batterers who are undeterred by the criminal justice response.
