A presente pesquisa tem como objetivo analisar as inconstitucionais restrições ao princípio constitucional da não cumulatividade do ICMS nas operações mercantis. Investiga a origem, a constitucionalização do princípio, os conflitos entre as restrições previstas na Constituição Federal de 1988 e a legislação infraconstitucional impostas pelo legislador ordinário que visam apenas privilegiar a arrecadação dos entes tributantes em detrimento do direito constitucional e dos limites impostos pelo legislador constituinte, restringindo a circulação de riquezas, se afastando da justiça tributária e social em completa violação dos direitos e garantias fundamentais dos contribuintes previstos na Constituição. Para estruturar a pesquisa qualitativa com base em fontes documentais, foram sistematizadas e analisadas as disputas para a constitucionalização da tributação na Constituição Federal de 1988; as normas de competências tributárias; os princípios relacionados à não cumulatividade; a regra matriz de ICMS; a legislação federal e do Estado de Sergipe e os regimes tributários mais comuns que suscitam as lides nos tribunais, com a finalidade demonstrar algumas modalidades de violação dos limites encartados na Constituição Federal de 1988. Vale ressaltar que este trabalho não pretende esgotar o tema, considerando a amplitude de possibilidades de restrições inconstitucionais ao princípio da não cumulatividade do ICMS que possam surgir nas diferentes legislações estaduais.

Transconstitutionalism is a concept used to describe what happens to constitutional law when it is emancipated from the state, in which can be found the origins of constitutional law. Transconstitutionalism does not exist because a multitude of new constitutions have appeared, but because other legal orders are now implicated in resolving basic constitutional problems. A transconstitutional problem entails a constitutional issue whose solution may involve national, international, supranational and transnational courts or arbitral tribunals, as well as native local legal institutions. Transconstitutionalism does not take any single legal order or type of order as a starting-point or ultima ratio. It rejects both nation-statism and internationalism, supranationalism, transnationalism and localism as privileged spaces for solving constitutional problems. The transconstitutional model avoids the dilemma of 'monism versus pluralism'. From the standpoint of transconstitutionalism, a plurality of legal orders entails a complementary and conflicting relationship between identity and alterity: constitutional identity is rearticulated on the basis of alterity. Rather than seeking a 'Herculean Constitution', transconstitutionalism tackles the many-headed Hydra of constitutionalism, always looking for the blind spot in one legal system and reflecting it back against the many others found in the world's legal orders.

Most major economies use a value added tax (VAT) which is a derivation of the French 1954 taxe sur la valeur ajoutée. The initial imposition of VAT in France and its spread around the world have been driven by economic reasons. This book focuses on one of these economic triggers: the neutrality of VAT as regards the functioning of the economy. It demonstrates that the reason VAT was chosen in France and why thereafter it spread around the world was because it offered the possibility to collect governmental revenue while allowing the economic forces of the market to interplay without being adversely affected. The prerequisite conditions for the existence of VAT neutrality are therefore identified herein along with an overview of the VAT mechanism, demonstrating that the concept of neutrality is built into the VAT system in a manner that allows for the preservation of the natural functioning of the market. After the definition of VAT neutrality is set forth, the elements that comprise VAT neutrality are tested against the realities on the ground and the issues that infringe the neutrality of VAT are identified and analysed. In conclusion, remedies for these issues are being sought by a review of the causes of infringement of VAT neutrality in the perspective of selected proposals for modified VAT systems. These proposals include redesignating the place where VAT is levied and improving VAT collection. Ultimately, the proposed solution has recourse to the roots of VAT together with the most advanced technological tools available to give back to VAT the power to levy revenue while letting the economic forces of the market interplay without instigating any adverse influence.
