"An important contribution to the dearth of literature of ASEAN and the law of the sea, this book is the result of extensive research by Dr. Tangsubkul, an international law specialist. The contents are divided into two broad areas. The first section on the evolution of the geo-juridical nature of ocean space appropriation by coastal states and ASEAN states covers: Claims of ASEAN states relating to the law of the sea: a historical survey; Individual approaches and claims of ASEAN countries on the emerging trends in the law of the sea; The special problems of passage through archipelagic waters and straits used for international navigation. The second section on problems relating to jurisdiction and rights over living and non-living resources of ASEAN countries covers: Fishery development in individual ASEAN countries; Problems of ASEAN vis-à-vis fishing resources; Status of development of petroleum and gas in individual ASEAN states; Law and practice relating to the jurisdiction and rights over non-living resources in ocean areas adjacent to ASEAN states; Problems and potential conflict involving off-shore exploration and exploitation of oil and gas."--P. [4] of cover.

The aim is to focus on a point of possible cooperation, somewhat in isolation from the many obstacles that clearly present themselves, in order to draw attention to the fact that despite obvious conflicts of interests, the oceans of Southeast Asia merit close attention as a possible focus for fresh initiatives in regional cooperation.

ASEAN has an abiding interest in peace and stability in this region and in freedom of navigation in and overflight above the South China Sea. Much of ASEANs commerce, including its members' traded food and energy resources, passes through or over the South China Sea. The stakes for ASEAN and its members in the South China Sea are very high. This book is the product of a conference on Entering Uncharted Waters? ASEAN and the South China Sea Dispute, initiated to remind all claimants to bring their claims as close as possible to the provisions of the 1982 UN Convention on the Law of the Sea. After all, ASEAN has sought to promote the rule of law in the region. The conference and this book were inspired by the following objectives: peace, stability, freedom of navigation and overflight, confidence building, cooperation, and the rule of law.

Law Of The Sea In South East Asia written by Donald R Rothwell and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-07-19 with Law categories.

The United Nations Convention on the Law of the Sea (LOSC) represents one of the most successful examples of multilateral treaty making in the modern era. The convention has 168 States parties, and most non-signatory States recognise nearly all of its key provisions as binding under customary international law, including the United States. Nevertheless, there remain significant differences in interpretation and implementation of the LOSC among States as well as calls, on occasion, for its amendment. This book analyses the impact, influence and ongoing role of the LOSC in South East Asia, one of the most dynamic maritime regions in the world. Maritime security is a critical issue within the region, and it is separately assessed in light of the LOSC and contemporary challenges such as environmental security and climate change. Likewise, navigational rights and freedoms are a major issue and they are evaluated through the LOSC and regional state practice, especially in the South China Sea. Special attention is given to the role of navies and non-state actors. Furthermore, the book looks at regional resource disputes which have a long history. These disputes have the potential to increase into the future as economic interests and concerns over food security intensify. Effective LNG and fisheries resource management is therefore a critical issue for the region and unless resolved could become the focal point for significant maritime disputes. These dynamics within the region all require extensive exploration in order to gauge the effectiveness of LOSC dispute resolution mechanisms. The Law of the Sea in South East Asia fills a gap in the existing literature by bringing together a holistic picture of contemporary maritime issues affecting the region in a single volume. It will appeal to academic libraries, government officials, think-tanks and scholars from law, strategic studies and international relations disciplines.

Ocean Politics In Southeast Asia written by Peter Polomka and has been published by Institute of Southeast Asian Studies this book supported file pdf, txt, epub, kindle and other format this book has been release on 1978 with Political Science categories.

The task of avoiding in the oceans - the 'last frontier' of our planet - the claims and rivalries that have caused endless conflict on land, has thrusted the 'ocean issues' increasingly into the forefrunt of international affairs. This book examines aspects of the interrelationship of diverse interests in the seas of Southeast Asia while suggesting scope for cooperative developments that might not only benefit the region but also have wider application in the emerging multipolar world.
