La décentralisation, facteur d’émancipation et d’efficacité, revêt deux formes distinctes qui sont liées. Elle s’opère du centre de l’appareil administratif vers la périphérie et de l’ensemble de cet appareil vers les libres organisations de la société civile. Les libertés locales et l’essor des associations doivent donc aller de pair, pour contribuer au développement économique et social des communes, départements, régions. Mais que faut-il, dans la pratique, pour qu’il en soit réellement ainsi ? Le présent ouvrage résume d’abord les tendances actuelles qui nécessitent, favorisent ou contrarient le progrès des actions concertées et des concours mutuels de ces partenaires, publics et privés. Puis il analyse de façon approfondie le droit et le fait en la matière, afin de préciser les objectifs et les moyens de la coopération dont il s’agit. This article deals with the literature on the French nonprofit sector (NPS). A preliminary part is devoted to presenting and discussing the characteristics that shape the approaches to this sector in France. In the second part, the article outlines some landmarks in the history of the French NPS. This literature review also focuses on empirical studies of the sector, placing a particular emphasis on the more recent ones. This review ends with the analysis of the challenges that NPS faces in a context characterized by the increasing constraints on public funding, changes in the nature of such funding with a substitution of contracts for subsidies, an increased competition among NPOs as well as between NPOs and for-profit enterprises.

The seminar on 'Freedom of Association' was held in Reykjavik (Iceland) from 26 to 28 August 1993. It was organised by the Directorate of Human Rights of the Council of Europe in cooperation with the Ministry of Justice of Iceland, and dealt with the following four themes: freedom of association and political democracy; freedom of association and civil society; freedom of association and social democracy; freedom to form and join or not to join trade unions. Written communications were presented on the following subjects: case law of Article 11 of the European Convention on Human Rights, freedom of association and the freedom of associations, freedom of association of immigrants in Europe, freedom of association and public service and freedom of association, labour law and the needs of a democratic society. About one hundred personalities took part: representatives of governments of member States, representatives of non-governmental organisations, members of the European Commission and Court of Human Rights, professors and other interested persons from Central, Western and Eastern Europe competent in the fields covered by the themes of the Seminar. This publication contains the Proceedings of the Seminar: the official speeches made at the opening ceremony, the reports and written communications, the interventions, the final report and the list of participants. Le Séminaire sur la 'Liberté d'association' a eu lieu à Reykjavik (Islande) du 26 au 28 août 1993. Il a été organisé par la Direction des Droits de l'Homme du Conseil de l'Europe en collaboration avec le Ministère de la Justice de l'Islande. Les travaux du Séminaire de Reykjavik ont été axés sur les quatre thèmes suivants: liberté d'association et démocratie politique; liberté des associations et société civile; liberté d'association et démocratie sociale; liberté de fonder avec d'autres des syndicats et de s'y affilier. This book is written around the central message that collectivist societies produce security, but destroy trust. In collectivist societies, people are connected through networks of strong personal ties where the behavior of all agents is constantly monitored and controlled. As a result, individuals in collectivist networks are assured that others will abide by social norms, and gain a sense of security erroneously thought of as “trust.” However, this book argues that this security is not truly trust, based on beliefs regarding the integrity of others, but assurance, based on the system of mutual control within the network. In collectivist societies, security is assured insofar as people stay within the network, but people do not trust in the benevolence of human nature. On the one hand, transaction costs are reduced within collectivist networks, as once accepted into a network the risk of being maltreated is minimized. However, joining the network requires individuals to pay opportunity cost, that is, they pay a cost by forgoing potentially superior opportunities outside the security of the network. In this era of globalization, people from traditionally collectivistic societies face the challenge of learning how to free themselves from the security of such collectivistic networks in order to explore the opportunities open to them elsewhere. This book presents research investigating how the minds of individuals are shaped by the conflict between maintaining security inside closed networks of strong ties, and venturing outside of the network to seek out new opportunities.
