L’interesse degli operatori giuridici ed economici verso il mondo del Terzo Settore è in rapida crescita, tanto da aver reso necessario un costante aggiornamento normativo culminato nella recente approvazione di un vero e proprio Codice del Terzo Settore (D.lgs. n. 117/2017). Le tematiche legate al settore no profit mantengono tuttavia come punto di riferimento la normativa codicistica in quanto è solo questa che pone le basi giuridiche utili a comprendere i meccanismi base che regolano la vita di tali enti. L’opera si propone di approfondire le tematiche e i principi stabiliti dal Codice Civile, pur riservando uno sguardo trasversale alle disposizioni, più o meno recenti, che stanno completando il quadro normativo di riferimento, con particolare riguardo, come giusto che sia, al Codice del Terzo Settore. Particolare attenzione è stata data alla dottrina, altro punto focale per comprendere al meglio il settore degli enti senza scopo di lucro. Nella scelta dei riferimenti giurisprudenziali, data la sporadicità della produzione giurisprudenziale su queste materie, è stato dato peso non solo alle pronunce più recenti, ma anche a quelle che, pur risalenti nel tempo, mantengono valenza e si rivelano, per questo, ancora attuali, avendo tracciato un solco che ancora oggi funge da linea guida.
