International law provides states with a common definition of a "refugee" as well as guidelines outlining how asylum claims should be decided. Yet even across nations with many commonalities, the processes of determining refugee status look strikingly different. This book compares the refugee status determination (RSD) regimes of three popular asylum seeker destinations: the United States, Canada, and Australia. Though they exhibit similarly high levels of political resistance to accepting asylum seekers, refugees access three very different systems-none of which are totally restrictive or expansive-once across their borders. These differences are significant both in terms of asylum seekers' experience of the process and in terms of their likelihood of being designated as refugees. Based on a multi-method analysis of all three countries, including a year of fieldwork with in-depth interviews of policy-makers and asylum-seeker advocates, observations of refugee status determination hearings, and a large-scale case analysis, Rebecca Hamlin finds that cross-national differences have less to do with political debates over admission and border control policy than with how insulated administrative decision-making is from either political interference or judicial review. Administrative justice is conceptualized and organized differently in every state, and so states vary in how they draw the line between refugee and non-refugee.

Troubled Transit considers the situation of asylum seekers stuck in limbo in Indonesia from a number of perspectives. It presents not only the narratives of many transit migrants but also the perceptions of Indonesian authorities and of representatives of international and non-government organizations responsible for the care of transiting asylum seekers. Fascinated by the extraordinary and seemingly limitless resilience shown by asylum seekers during their often lengthy and dangerous journeys, the author highlights one particular fragment of their journeys — their time in Indonesia, which many expect to be the last stepping stone to a new life. While they long for their new life to unfold, most asylum seekers become embroiled in the complexities of living in transit. Indonesia, a vast archipelago of more than 17,000 islands, is more than a location where people spend time waiting; it is a nation state that interacts with transiting asylum seekers and formulates policies that have a profound impact on their experience in transit there. Troubled Transit tries to explain the complexities faced by the transiting migrants within the context of the Indonesian government and its political challenges, including its relationship with Australia. The Australia-centric view of recent asylum seeker issues has tended to ignore the larger socio-political context of the migratory routes and the perspectives of transit states towards asylum seekers stuck in transit. This book hopes to direct the Australia-centric gaze northwards to take Indonesian policies and policymaking into account, thereby giving Indonesia more relevance as a transit country and as an important partner in regional protection schemes and migration management. Even though some Indonesian policies and practices are less than favourable for asylum seekers, and even reprehensible from a human rights perspective, more attention must be paid to ongoing developments that impact on transiting asylum seekers in Indonesia if any of the hardships they suffer there are to be alleviated.

Why do states protect refugees? In the past twenty years, states have sought to limit access to asylum by increasing their border controls and introducing extraterritorial controls. Yet no state has sought to exit the 1951 Refugee Convention or the broader international refugee regime. This book argues that such international policy shifts represent an ongoing process whereby refugee protection is shaped and redefined by states and other actors. Since the seventeenth century, a mix of collective interests and basic normative understandings held by states created a space for refugees to be separate from other migrants. However, ongoing crisis events undermine these understandings and provide opportunities to reshape how refugees are understood, how they should be protected, and whether protection is a state or multilateral responsibility. Drawing on extensive archival and secondary materials, Phil Orchard examines the interplay among governments, individuals, and international organizations that has shaped how refugees are understood today.

Refugees and migration are not a new story in the history of humankind, but in the last few years, against a backdrop of huge numbers of migrants, especially from war-torn countries, they have again been a topic of intensive and contentious discussion in politics, the media and scientific publications. Two United Nations framework declarations on the sustainable development goals and on refugees and migrants adopted in 2016 have prompted the editors – who have a background in international criminology – to invite 60 contributors from different countries to contribute their expertise on civic education aspects of the refugee and migrant crisis in the Global North and South. Comprising 35 articles, this book presents an overview of the interdisciplinary issues involved in irregular migration around the world. Asylum seekers are not welcome in Europe. But why is that the case? For many scholars, the policies have become more restrictive over recent decades because the asylum seekers have changed. This change is often said to be about numbers, methods of travel, and reasons for flight. In short: we are in an age of hypermobility and states cannot cope with such volumes of ‘others’. This book presents an alternative view, drawing on theoretical insights from Third World Approaches to International Law, post- and decolonial studies, and presenting new research on the context of the British Empire. The text highlights the fact that since the early 1990s, for the first time, the majority of asylum seekers originate from countries outside of Europe, countries which until 30-60 years ago were under colonial rule. Policies which address asylum seekers must, the book argues, be understood not only as part of a global hypermobile present, but within the context of colonial histories.

An increasing number of landings of illegal migrants on the coast of Italy and Spain, but also the recent riots, car-burnings, and street battles that occurred all across France and that have been attributed to the migrant community, seem to indicate that migration is likely to stay high on the European policy agenda for some time. The flow of migrants from poor to rich countries does not, however, constitute a typically European problem. V. S. public policy has also been facing a continued (legal and illegal) inflow of labor from different regions, notably Mexico and other Latin American countries. And similar developments in other advanced countries (Australia, Canada) as weil as in selected fast-growing emerging markets in Eastern Europe and East Asia imply that these countries too are being compelled to adjust their public policies in order to relieve migratory pressures and deal with their consequences. The world economy already saw rising cross-border labor flows in the 1990s and most forecasts predict that South-North and South-South migration will re main at relatively high levels over the next decades and possibly even turn into a major global challenge for policy makers in the 21st century.
