Dedicato ai rapporti tra ateismo e libertà religiosa nell’ordinamento giuridico italiano, il libro ne segue l’evoluzione storico-giuridica spingendo l’indagine oltre la rilevazione delle garanzie normative della libertà, per cercare di «individuare, al di là del significato letterale, il valore reale, l’incidenza sociale di norme e concetti giuridici che, pur non esprimendosi mai apertamente in questa direzione, favoriscono poi incisivamente la diffusione della religione (e di una determinata religione) ostacolando quella dell’ateismo». Proponendo e sperimentando questo percorso, il libro è riuscito a scuotere il dibattito scientifico su ateismo e religione in corso negli anni Settanta, indicando un metodo d’indagine ancora oggi utile a guidare e stimolare la ricerca di una protezione giuridica equilibrata della libertà di credere e di non credere. This volume presents results from new and ongoing research efforts into the role of nonreligion in education, politics, law and society from a variety of different countries. Featuring data from a wide range of quantitative and qualitative studies, the book exposes the relational dynamics of religion and nonreligion. Firstly, it highlights the extent to which nonreligion is defined and understood by legal and institutional actors on the basis of religions, and often replicates the organisation of society and majority religions. This book outlines the legal status of Muslims in Italy.
