With growing home ownership, more people will both bequeath and inherit assets. This has raised a number of issues central to policy and political debates relating to inheritance tax, retirement and pensions, the use of assets to pay for long-term care in later life and the role of assets in welfare more generally. All of these policy areas can be better informed through an understanding of public attitudes to assets and inheritance. This report draws on evidence from the first nationally representative survey of attitudes to inheritance in Britain. The main aims of the study were to explore the level of support for the concept of inheritance and how this varies by age, family-type and socio-economic status, as well as how attitudes to inheritance affect financial behaviour. Over 2,000 adults were surveyed. Focus groups of owner-occupiers in different age bands were also interviewed. The findings and implications for policy are fully discussed with over 50 figures and tables presenting the data in an easy-to-read format. an interest in issues around inheritance, housing assets and living-standards, including: policy-makers in central and local government; the financial services sector; the housing sector; academics; consumer groups; and the voluntary sector.

The purpose of this study was to examine attitudes about who should be included in a will following divorce and remarriage. Multiple-paragraph vignettes describing different situations involving family members that should be included in the will of an elderly farmer were responded to by 268 men and 439 women from a Midwest state. Variables manipulated in the paragraphs included family closeness, contact after divorce, and remarriage of the middle generation's adults. Obligations regarding inheritance were not seen as contextual. Approximately two-thirds of the respondents thought there was an obligation to leave an inheritance to family members, most specifically the only son, regardless of the 24 different variations of the vignettes. Closeness and contact with the elderly farmer did appear to influence the selection of the daughter-in-law and the grandchildren to be included in the will. The new spouse and stepchild from the remarriage were selected to be included in the will less than 5% of the time. Non-family members and institutions were rarely selected as an alternative to family members. The main finding was that inheritance was seen as a resource that should be distributed directly through biological connections.

This paper reports on the findings from a large-scale study of public attitudes to inheritance law, particularly the rules on intestacy. It argues that far from the assumption that the family' is in terminal decline, people in England and Wales still view their most important relationships, at least for the purposes of inheritance law, as centred on a narrow, nuclear family model. However, there is also widespread acceptance of re-partnering and cohabitation, producing generally high levels of support for including cohabitants in the intestacy rules and for ensuring that children from former relationships are protected. We argue that these views are underpinned by a continuing sense of responsibility to the members of one's nuclear family, arising from notions of sharing and commitment, dependency and support, and a sense of lineage.

This report provides robust data on attitudes in England and Wales to will-making and what the law should be when people die without making a will (intestacy). Evidence from the study is being used by the Law Commission to review how inheritance law should be shaped for a society in which divorce, remarriage and cohabitation have become common features of family life. This was a mixed method study. The quantitative element comprised a module of questions run on two consecutive waves of the NatCen Omnibus Survey in 2009, the second wave being used to boost the number of respondents in certain key groups of interest. The qualitative study involved 30 depth interviews with people who had taken part in the survey, purposively sampled in order to explore a range of views and attitudes in more detail. The study found that around one-third of respondents had made a will and there was strong support for the principle of freedom of testation. The range of beneficiairies mentioned in the will or considered as eligible to inherit on intestacy, was narrow, largely confined to spouses or partners and children or, in their absence, parents and siblings. More remote kin, and friends, carers and charities were much less commonly mentioned. Respondents were supportive of including cohabitants in the intestacy rules, though evidence of their 'commitment' to the deceased was important, to be shown either by having a child together or by the duration of their relationship. They were also keen to ensure that children of former relationships are not excluded from provision because of the deceased's marriage to a second spouse.
