Comment peut-on être transhumant en ce début de XXIe siècle ? Comment peut-on l'être dans un pays comme le Tchad, réputé depuis de longues décennies pour son insécurité ? Pourquoi des familles entières préfèrent-elles passer leur vie à accompagner leurs troupeaux sur des centaines de kilomètres plutôt que de rester tranquilles à la même place ? Plus encore, comment sur de telles distances, avec principalement des dromadaires dont le comportement est si peu grégaire, parviennent-elles à cohabiter avec les autres communautés d'agriculteurs ou d'éleveurs ? Autant d'interrogations et de défis que le présent ouvrage s'efforce d'éclairer. Et cela de manière originale, non pas en se les posant de façon générale mais en les vivant de l'intérieur. En effet, deux étudiants, l'un tchadien, l'autre expatrié, tous deux arabisants, ont vécu six mois durant dans un campement de chameliers et ont pu observer, au quotidien, les activités de ces familles tout au long de leur transhumance du nord au sud, depuis la fin des pluies jusqu'à la saison froide. Pour les lecteurs peu familiers des espaces sahéliens, ce sont trois grandes idées préconçues qui se trouvent ici directement mises en question. D'abord, ébranlant l'image habituellement médiatisée du contexte tchadien, nous voyons des pasteurs qui, malgré l'insécurité, grâce à leur ingéniosité et à une organisation sociale exceptionnelle, savent développer de réelles capacités à poursuivre leur élevage. Ensuite, nous sommes en présence d'un groupe humain qui, à la faveur de sa mobilité et de sa flexibilité, réussit remarquablement à tirer parti de la grande variabilité des pâturages et des points d'eau. Enfin, le relevé des faits bat en brèche l'opinion qui voudrait que les transhumants se comportent tous comme des envahisseurs auprès des agriculteurs, alors qu'au contraire nous les voyons ici développer des alliances avec ces derniers et entretenir des relations de réelle complémentarité.

In this volume, ownership is defined as the simple fact of being able to describe something as 'mine' or 'yours', and property is distinguished as the discursive field which allows the articulation of attendant rights, relationships, and obligations. Property is often articulated through legalism as a way of thinking that appeals to rules and to generalizing concepts as a way of understanding, responding to, and managing the world around one. An Aristotelian perspective suggests that ownership is the natural state of things and a prerequisite of a true sense of self. An alternative perspective from legal theory puts law at the heart of the origins of property. However, both these points of view are problematic in a wider context, the latter because it rests heavily on Roman law. Anthropological and historical studies enable us to interrogate these assumptions. The articles here, ranging from Roman provinces to modern-day piracy in Somalia, address questions such as: How are legal property regimes intertwined with economic, moral-ethical, and political prerogatives? How far do the assumptions of the western philosophical tradition explain property and ownership in other societies? Is the 'bundle of rights' a useful way to think about property? How does legalism negotiate property relationships and interests between communities and individuals? How does the legalism of property respond to the temporalities and materialities of the objects owned? How are property regimes managed by states, and what kinds of conflicts are thus generated? Property and ownership cannot be reduced to natural rights, nor do they straightforwardly reflect power relations: the rules through which property is articulated tend to be conceptually subtle. As the fourth volume in the Legalism series, this collection draws on common themes that run throughout the first three volumes: Legalism: Anthropology and History, Legalism: Community and Justice, and Legalism: Rules and Categories consolidating them in a framework that suggests a new approach to legal concepts.

A focus on the everyday has produced this ethnography, which hopes to give a nuanced voice to an extended family of semi-sedentary nomads, living at the centre of a country and region known for its political turmoil, ecological insecurities, and socio-economic hardship. The everyday of the Chadian Walad Djifir is one in which sedentarity and mobility are approached as two entwined parts of a whole, and where economic and geographical boundaries do not necessarily form constrictions. The ferīkh (nomadic camp) is where all of the Walad Djifir’s networks meet, and often also begin— a physical place embodying various networks and connections, which span time and geographical space. This analytical and methodological approach gives insight in how regional trends can be understood in light of the Walad Djifir’s daily lives. Over time, the Walad Djifir have developed ways of coping and dealing with insecurities, interacting with infrastructural, technological, and socio-political developments in specific ways. In exploring how such insecurities and crises become anchored into the everyday, the ferīkh provides answers. It is precisely the mundane elements of daily life which anchor disruption.

Les réseaux et les trajectoires de migrations des jeunes sont le point d‘entrée de cette analyse des changements structurels dans les sociétés pastorales. Au Tchad, les migrations temporaires vers la Lybie, le Soudan et les sites d‘orpaillage sont entravées par la crise sécuritaire et réprimées par l’armée. La diversification des économies familiales pastorales varie selon les groupes (Kreda, Arabes, Peuls). Les institutions familiales et communautaires jouent un rôle clé dans l’intégration urbaine. Au Burkina Faso, les migrations sont stimulées par une crise pastorale complexe, aiguisée par l’affaiblissement des droits fonciers et le ralentissement du transfert inter générationnel des droits sur le bétail. L’émancipation des jeunes pasteurs n’est plus garantie par les pratiques d’élevage et le transfert des droits sur le bétail, mais reste étroitement liée à l’économie familiale. Dans les deux pays, les villes, avec le commerce de bétail et l’éducation non formelle, sont des lieux où de nouveaux liens sociaux se créent entre citoyenneté nationale et parentalité. Les installations en périphérie et la mobilité pastorale ne s’opposent pas, à l’échelle des familles et des communautés. Les familles pastorales, et les jeunes générations en particulier, sont à la recherche de nouvelles formes de relations avec l’Etat. Trois manières de prendre en compte ces nouvelles connections entre milieux rural et urbain sont: 1) soutenir les systèmes pastoraux; (2) fournir aux campements pastoraux des services sociaux de base, en particulier l’accès à l’éduction; (3) reconnaitre le droit de combiner la mobilité pastorale et l’accès aux droits civiques nationaux.

This volume on the ecology of Mauritanian coastal waters and in particular the Banc d'Arguin, allows us to understand the functioning of this remarkable coastal wetland. Major questions concern the interaction between the Banc d'Arguin ecosystem on the one hand and the adjoining systems of the open ocean with its intensive upwelling phenomena and the Sahara desert on the other. Is the Banc d'Arguin ecosystem relatively isolated from its surroundings and does it function as a tropical pocket in a more temperate surrounding, as suggested by Sevrin-Reyssac (1983); or does it interact with both the Sahara and the Atlantic Ocean? At the Banc d'Arguin, the area between the estuarine parts and the open ocean is extremely shallow and largely uncharted. Large research vessels cannot penetrate the shallows, whereas small vessels are often unable to negotiate the outer part of the shallow area due to rough weather conditions. Hence, separate teams report on work at the seaward side of this shallow sill and at the landward side. In addition, other teams address different questions, such as the productivity of the seagrass beds and the benthic fauna, the number of birds spending the summer at the Banc d'Arguin, and the distribution of several taxonomic groups of flora and fauna.
