English summary: This dissertation deals with a lot of questions, which are relevant for both the environmental criminal law and for the establishment criminal law. Often, environmental criminal actions are committed by companies. To prosecute these companies it is difficult for the enforcement authorities, but at the same time there is an increasing risk of criminal liability for the company members. A good solution for both parties could be a transfer of the EMAS-system. A fundamental element of this system is a voluntairy co-operation of companies for a community system for environmental management and an environmental management check. In the centre of this dissertation is the question, if and in which dimention the EMAS-System will be a relief for the environmental law for companies. Beyond that the issue of further possitive as well as negative penal impacts of EMAS will be treated. German text. German description: Umweltstraftaten werden besonders haufig in Unternehmen begangen. Deren strafrechtliche Ahndung bereitet den Strafverfolgungsbehorden erhebliche Schwierigkeiten, zugleich ist die Gefahr eines erhohten Strafbarkeitsrisikos der Unternehmensangehorigen gegeben. Fur beide Seiten konnte im sogenannten Oko-Audit eine hilfreiche Losung liegen. Wesentlicher Inhalt ist die freiwillige Beteiligung von Unternehmen an einem Gemeinschaftssystem fur das Umweltmanagement und die Umweltbetriebsprufung. Im Mittelpunkt der Arbeit steht die Frage, ob und in welchem Ausmass dem Oko-Audit das Potenzial fur eine umweltstrafrechtliche Entlastung des Unternehmens zuzusprechen ist. Daruber hinaus werden weitere positive, aber auch negative strafrechtliche Auswirkungen des Oko-Audits thematisiert.

As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. The privilege against self-incrimination is often represented in the case law of England and Wales as a principle of fundamental importance in the law of criminal procedure and evidence. A logical implication of recognising a privilege against self-incrimination should be that a person is not compellable, on pain of a criminal sanction, to provide information that could reasonably lead to, or increase the likelihood of, her or his prosecution for a criminal offence. Yet there are statutory provisions in England and Wales making it a criminal offence not to provide particular information that, if provided, could be used in a subsequent prosecution of the person providing it. This book examines the operation of the privilege against self-incrimination in criminal proceedings in England and Wales, paying particular attention to the influence of the European Convention on Human Rights and the Human Rights Act 1998. Among the questions addressed are how the privilege might be justified, and whether its scope is clarified sufficiently in the relevant case law (does the privilege apply, for example, to pre-existing material?). Consideration is given where appropriate to the treatment of aspects of the privilege in Australia, Canada, India, New Zealand, the USA and elsewhere.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.
