Met de wet van 16 juli 2008 heeft de wetgever een bijzonder fiscaal regime ingevoerd dat van toepassing is op alle inkomsten die voortkomen uit de cessie en concessie van auteursrechten en naburige rechten.0In dit boek ontleedt auteur Jasper Bossuyt deze regelgeving grondig: de praktische interpretatieproblemen, het toepassingsgebied, de aanvalsroutes van de administratie bij oneigenlijk gebruik, de visie van rulingdienst en de rechtspraak, enz. Ook de kwalificatie van auteursrechten vóór de inwerkingtreding van het specifiek fiscaal regime komt aan bod. Deze blijft immers tot op de dag van vandaag relevant. De bijzondere fiscale regeling bleef in de rechtsleer niet zonder kritiek. Het brengt praktische toepassingsproblemen met zich mee, maar er is mogelijk ook een fundamenteler probleem. De vraag rijst of deze fiscale regelgeving in overeenstemming is met het grondwettelijk verankerd gelijkheidsbeginsel.
