The automated filtering of upload attempts to online platforms is one of the most contentious issues in the fields of copyright enforcement and platform regulation. Notwithstanding the impassioned debate, research from a law and economics perspective is scarce. This book presents the first comprehensive economic analysis of automated copyright filtering. The author develops an economic model of the competition between right holders and copyright-infringing uploaders on a platform. Furthermore, he applies insights from the economic literature on decision-making under uncertainty and incentive alignment to automated copyright filtering. The analysis disentangles complex relationships and challenges prevailing assumptions. It offers a novel perspective on the implications of automated filtering for the objectives of copyright policy, on the avoidance of erroneous filtering decisions, and on regulatory approaches to automated filtering. The author employs his findings to evaluate the current US and EU legal frameworks and proposes improvements. This book will appeal to researchers and policy makers interested in automated filtering, copyright enforcement, and platform regulation.

Political Automation written by Eduardo Albrecht and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2025-02-21 with Political Science categories.

Governments now routinely use AI-based software to gather information about citizens and determine the level of privacy a person can enjoy, how far they can travel, what public benefits they may receive, and what they can and cannot say publicly. What input do citizens have in how these machines think? In Political Automation, Eduardo Albrecht explores this question in various domains, including policing, national security, and international peacekeeping. Drawing upon interviews with rights activists, Albrecht examines popular attempts to interact with this novel form of algorithmic governance so far. He then proposes the idea of a Third House, a virtual chamber that legislates exclusively on AI in government decision-making and is based on principles of direct democracy, unlike existing upper and lower houses that are representative. Digital citizens, AI powered replicas of ourselves, would act as our personal emissaries to this Third House. An in-depth look at how political automation impacts the lives of citizens, this book addresses the challenges at the heart of automation in public policy decision-making and offers a way forward.

Artificial Intelligence (AI) has become omnipresent in today's business environment: from chatbots to healthcare services to various ways of creating useful information. While AI has been increasingly used to optimize various creative and innovative processes, the integration of AI into products, services, and other operational procedures raises significant concerns across virtually all areas of intellectual property (IP) law. While AI has drawn extensive attention from IP experts globally, this is the first book providing a broad and comprehensive picture from the perspectives of the very nature of AI technology, its commercial implications, its interaction with different kinds of IP, IP administration, software and data, its social and economic impact on the innovation policy, and ultimately AI's eligibility as a legal entity.

Law Regulation And Governance In The Information Society written by Maurizio Borghi and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-12-30 with Law categories.

This edited collection seeks to map the landscape of contemporary informational interests, to evaluate a range of recognised and putative rights and wrongs associated with modern information societies, and to consider how law, regulation, and governance should be deployed in response. New technologies and new applications constantly disrupt our values, our framing of our world, and our sense of where we are and who we are. In our ‘information societies’, we entertain mixed hopes and expectations, as well as significant fears and concerns. At the root of these, there are a number of informational interests, on the basis of which certain rights are claimed and particular wrongs denounced. This book addresses these interests, considering them as relating primarily to the integrity of the informational ecosystem, to the accessibility, accuracy, and authenticity of public information, and to our individual ability to control the outward and inward flows of information that relates directly to ourselves. Covering a wide range of subjects, the book’s interrogation of our contemporary information society is oriented around two questions: first, whether the information society in which we live is the kind of society that we think it should be and, second, if not, what we can reasonably expect law, regulation, and governance to do in providing the basis for improving it. This book will be of considerable interest to those working at the intersection of law and technology, as well as others concerned with the legal, political, and social aspects of our information society.

Intellectual Property Law and Human Rights Fourth Edition Edited by Paul L.C. Torremans Once regarded as a niche topic, the nexus of intellectual property and human rights now lies in the eye of the storm that is today’s global economy. In this expanded new edition of the pre-eminent work in this crucial area of legal theory and practice – with nine completely new chapters – well-known authorities in both intellectual property law and human rights law present an in-depth analysis and discussion of essential and emerging issues in the convergence of intellectual property law and human rights law. The fourth edition is fully updated to address current matters as diverse as artificial intelligence, climate change, and biotechnological materials, all centred on the relations between intellectual property and freedom of expression and the fundamental right to privacy in an intellectual property environment. The contributors address such topics as the following and more: the status of copyright as a fundamental right; fair use, transformative use, and the US First Amendment; intellectual property in the jurisprudence of the European Court of Human Rights; freedom to receive and impart information under the EU Charter of Fundamental Rights; how to mitigate the risks article 17 of Directive 2019/970 poses to freedom of expression; fair dealing defences; algorithmic copyright enforcement and free speech; developing a right to privacy for corporations; expanding the role of morality and public policy in European patent law; and ethical and religious concerns over patenting biotechnological inventions. As human rights issues continue to arise in an intellectual property context, practitioners, academics, and policymakers in both fields will continue to recognize and use this well-established cornerstone work in the debate as a springboard to the future development of the ever more prominent interface of intellectual property and human rights.
