Globalization has challenged concepts such as local culture and cultural autonomy. And the rampant commodification of cultural products has challenged the way we define culture itself. Have these developments transformed the relationship between culture and autonomy? Have traditional notions of cultural autonomy been recast? This book showcases the work of scholars who employ a broad definition of culture to trace how issues of cultural autonomy have played out in various arenas, including literary criticism, indigenous societies, the Slow Food movement, and skateboarding culture. Although they focus on the marginalized issue of autonomy, they reveal that globalization has both limited as well as created new forms of cultural autonomy.

Secessionism written by Jason Sorens and has been published by McGill-Queen's Press - MQUP this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012-02-13 with Political Science categories.

Using innovative methods to analyze both advanced democracies and developing countries, Jason Sorens shows how central governments can alleviate or increase ethnic minority demands for regional autonomy. He argues that when countries treat secession as negotiable and provide legal paths to pursuing it rather than absolutely prohibiting independence, violence is far less likely. Additionally, independence movements encourage government policies of decentralization that may be beneficial to regional minorities. An informative investigation of the root causes of political violence, Secessionism provides a clear-eyed look at independence movements for both governments and secessionists.

The Rome I Regulation on the Law Applicable to Contractual Obligations has unified the conflict of laws rules of the Member States. The influence of the European Union upon Private International Law goes beyond positive harmonisation however. There is a certain tension between European law and PIL. European law is concerned with whether the imposition of a rule constitutes a restriction to the internal market whereas PIL does not seek to neutralise the disadvantages that result from differences between national laws but instead tries to locate the geographical centre of the legal relationship. The present book attempts to identify the methodological disharmony between the two legal disciplines in the regulation of cross border contracts and proposes suggestions to enhance their mutual understanding.

The Shifting Allocation Of Authority In International Law written by Tomer Broude and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2008-06-13 with Law categories.

International law is fragmented and complex, and at the same time increasingly capable of shaping reality in areas as diverse as human rights, trade and investment, and environmental law. The increased influences of international law and its growing institutionalization and judicialization invites reconsideration of the question how should the authority to make and interpret international law be allocated among states, international organizations and tribunals, or in other words, "who should decide what" in a system that formally lacks a central authority? This is not only a juridical question, but one that lies at the very heart of the political legitimacy of international law as a system of governance, defining the relationship between those who create the law and those who are governed by it in a globalizing world. In this book, leading international legal scholars address a broad range of theoretical and practical aspects of the question of allocation of authority in international law and debate the feasibility of three alternative paradigms for international organization: Sovereignty, Supremacy and Subsidiarity. The various contributions transcend technical solutions to what is in essence a problem of international constitutional dimensions. They deal, inter alia, with the structure of the international legal system and the tenacity of sovereignty as one of its foundations, assess the role of supremacy in inter-judicial relations, and draw lessons from the experience of the European Union in applying the principle of subsidiarity. This volume will be of great interest to scholars and practitioners of international law alike.
