La prevalenza della sostanza sulla forma nel diritto tributario affronta la tematica partendo da una considerazione di fondo: che, da molto tempo, viene attribuita una “patente di verità” a tutto ciò che è sostanza ed una connotazione marcatamente negativa a tutto ciò che è forma. In via preliminare, quindi, si cercherà di comprendere se la prevalenza della sostanza sulla forma sia davvero annoverabile tra i principi generali dell’ordinamento tributario (o se, invece, rappresenti solamente lo strumento per l’affermazione di altri principi e valori) e, ad un successivo livello di analisi, a quale sostanza occorra fare riferimento. La parte centrale del lavoro – il quale, giova precisarlo, adotta un approccio sostanzialistico – è incentrata sull’analisi dei rapporti tra la prevalenza della sostanza sulla forma e l’art. 53 Cost. al quale la Suprema Corte, dopo le note sentenze gemelle del 2008 in materia di abuso del diritto, ha attribuito una diretta precettività. Si analizzeranno, quindi, le implicazioni di tale nuovo ruolo assunto dal principio di capacità contributiva, declinato in termini di effettività, e di come tale principio debba essere interpretato e valorizzato in chiave “biunivoca”, sia nell’ambito delle patologie, sia in quello dell’attuazione fisiologica del tributo.
