This book brings together recent research by a group of specialists in history and sociology to provide a new reading of the late Franco dictatorship, especially in relation to its political culture. The authors focus on the election of local, trade union and national representatives, the work of the first Spanish sociologists, the struggle over administrative reform, the role of the media and the intellectuals, as well as the evolution of the dictatorships political class and its response to the regimes decline. Not only are the politics of the late dictatorship scrutinised, but also the mechanisms that were deployed to control the fast-changing society of the 1960s and 1970s. In examining the late Franco period, the contributors do not believe that it contained the seeds of Spains later democratisation, but maintain that certain sectorial regime initiatives -- electoral and political changes, an evolving discourse and an interest in political processes outside Spain -- made many Spaniards aware of the dictatorships contradictions and limitations, thereby encouraging its subsequent political and social evolution. This transformation is compared with the latter stages of the parallel dictatorship in Portugal. The great majority of Spaniards felt that the embrace of democratic freedoms and integration into the European Community was the only way forward during the Transition. But the shift from dictatorship to democracy from the 1960s onwards in Spain needs to be understood in relation to the multitude of political and social changes that took place -- despite the opposition of Franco and the bunker mentality of the regime. These changes manifested in a complex interaction between internal and external factors, which eventually resulted in the transformation of Spanish society itself.

El régimen franquista (1936/39-1975) no solo fue una de las dictaduras más longevas en la Europa del siglo XX, sino también una de las más estables. Esta singularidad se explica por la «reinvención» del régimen como dictadura desarrollista con el objetivo de catapultar al país a la era industrial, imitando para ello el modelo de planificación francés. En este sentido, el análisis se centra en el principal arquitecto de esta estrategia de legitimación, Laureano López Rodó, comisario del Plan de Desarrollo entre 1962 y 1973. Suyo fue el impulso para intentar estabilizar el régimen a través de la eficacia administrativa, el éxito económico y la integración en Occidente. La autora desarrolla una nueva interpretación del segundo franquismo al mostrar cómo, paradójicamente, su política acabó sentando las bases para la erosión de la dictadura porque contribuyó a agudizar las luchas de poder en la élite franquista y expuso el régimen a la crítica. Se analiza en profundidad y con una perspectiva novedosa el intento de relegitimar el régimen franquista como dictadura desarrollista desde la década de 1950 hasta su derrumbe. Contextualizando la historia del régimen en la historia europea de posguerra y de la Guerra Fría, se esclarecen tanto las raíces del desarrollismo franquista y la aplicación de la política de planificación como el objetivo de crear una sociedad apolítica de «administrados». Al mismo tiempo, se demuestra que el proyecto de relegitimar la dictadura mediante el éxito económico se convirtió cada vez más en objeto de crítica pública, contribuyendo así a la pérdida de legitimidad del régimen.

La oposición representada por éstos en la etapa estudiada, no está suficientemente investigada, lo que resulta tanto más llamativo cuanto que a la altura de los años 60 los democristianos parecían, según las encuestas disponibles, una alternativa política plausible a la Dictadura.

Las dictaduras no rehúyen el Derecho. Siempre lo han utilizado. Emulando otros ejemplos de los totalitarismos europeos, la dictadura franquista no fue una excepción. Se dotó de un sistema institucional dirigido a construir un Estado regido por un ordenamiento jurídico con la pretensión de legitimar un régimen surgido del golpe de estado contra la II República. El franquismo creó un Estado con Derecho, un Estado administrativo, pero en ningún caso un Estado de Derecho. A pesar de los esfuerzos de sus juristas apologetas que pretendieron aportar un cuerpo teórico tanto a su organización institucional como a la represión ejercida por leyes y tribunales. Desde 1936 hasta la muerte del dictador en 1975, una parte de ese Derecho estaba formada por un amplio arsenal de disposiciones y jurisdicciones especiales concebidas para la represión del opositor político. Era su Derecho represivo. Junto al examen de la experiencia profesional de los abogados en el ejercicio del derecho de defensa, el libro estudia, desde la perspectiva jurídica, los diversos períodos represivos que jalonaron la larga dictadura, a través de la violencia ejercida sobre los ciudadanos y la represión de la lucha por la libertad.
