Los pactos suscritos por los miembros de una pareja no casada, en análoga relación de afectividad a la marital, vienen a ordenar los efectos personales y patrimoniales de la convivencia, así como los efectos del cese de la misma, e incluso también contienen la previsión de un hipotético cese de la convivencia o de una futura extinción por causa de muerte de uno de sus miembros. Sin regulación en el derecho civil común, han sido los derechos civiles territoriales los que han reconocido las distintas tipologías de lo que en el Derecho anglosajón se denominan ?prenupts?. Tal vez no siempre con absoluta cobertura constitucional, actualmente contamos con el artículo 25 de la Ley 10/2007, de 20 de marzo, de Régimen Económico Matrimonial valenciano o el artículo 172 de la Ley 2/2006, de 14 de junio, de Derecho civil de Galicia, y aunque de manera muy superficial, parece referirse también a este tipo de pactos el artículo 10.2 de la Ley 5/2002, de 16 de diciembre, sobre parejas de hecho en la Comunidad Autónoma de Andalucía. Pero ha sido el legislador catalán el que ha creado un régimen jurídico completo en torno a las distintas tipologías de pactos convivienciales, partiendo del que fuera artículo 15 del Código de Familia para desembocar en el actual artículo 231-30 del Código civil de Cataluña. Se trata de una regulación que, sin ninguna duda, habrá de ser tenida muy en cuenta si el legislador estatal quisiera, de una vez por todas, acometer una regulación integral de las parejas no casadas. Ante la justificada ausencia de un complejo orgánico normativo que regule los efectos que derivan de la convivencia "more uxorio" - a excepción de la ley 10/1998 de 15 de Julio de Uniones Estables de pareja aprobada por el Parlamento de Cataluña y la Ley 6/1999 de 26 de marzo relativa a Parejas Estables no casadas aprobada por las Cortes de Aragón-, y estimando que la aplicación analógica y en bloque de las normas previstas para el matrimonio no podrá hacerse a la unión libre, el objetivo de este trabajo se ha centrado en tratar de defender y justificar que será la autonomía de la voluntad la que ha de desplegar todos sus efectos, traduciéndose ésta, en la libre y responsable regulación convencional o pactada que hagan los convivientes de su propio estatuto personal y patrimonial; vienen promocionando un sistema de pactos que -en nuestra opinión- resulta más respetuoso con la manifiesta voluntad de no casarse que con una regulación impuesta legalmente. Sin embargo, el hecho de otorgar eficacia jurídica a un pacto sobre relaciones personales, puesto que deviene incuestionable la validez del pacto puramente patrimonial, nos ha llevado a partir de la hipótesis de que los deberes de convivencia, fidelidad, respeto y socorro mutuo, no son patrimonio exclusivo del matrimonio y por tanto, un convenio por el que los convivientes asumen libre, responsable y recíprocamente las obligaciones contenidas en los arts. 67 y 68 del C.c puede ser operativo, porque ciertamente no contraviene ninguna norma que lo prohíba, no es contrario a la moral y tampoco conculca el orden público familiar. Un pacto de esta clase, en principio, sería lícito y su incumplimiento daría lugar a una suerte de obligación natural que, al momento de la crisis se torna en obligación jurídica y desde luego obliga a resarcir.

El tema de este libro se inserta en el debate sobre el alcance de la autonomía de la voluntad en el contexto matrimonial y, concretamente, se examina el contrato de capitulaciones matrimoniales como sede susceptible de albergar la autorregulación de las consecuencias personales y patrimoniales de una eventual ruptura matrimonial. También se examina la irradiación del debate sobre la eficacia de determinados derechos y libertades de rango constitucional hacia los límites de la autonomía privada de los cónyuges. El análisis se traslada asimismo a la consideración de otras importantes cuestiones relacionadas con la naturaleza jurídica del acuerdo en previsión de ruptura matrimonial, así como a algunos otros controvertidos aspectos referidos a su validez y eficacia. El libro amplía el alcance de su investigación a otros dos sistemas legales al incursionar en el estudio de la normativa estadounidense y de la puertorriqueña.
