So ist es dem Autor zu verdanken, dass er seine Rekonstruktion der historischen Krankenhausentwicklung in konstruktive Vorschläge überführt, die Patientenbehandlung als gelingenden Interaktionsprozess zwischen den Mitarbeitern und den Patienten im Krankenhaus zu kultivieren. Unzulässige Zusammenarbeit im Gesundheitswesen stellt den Gesetzgeber seit geraumer Zeit vor enorme Herausforderungen. Mit Einführung der Straftatbestände der Bestechlichkeit und Bestechung im Gesundheitswesen (§§ 299 a/b StGB) im Juni 2016 ist sie erneut in den Fokus der Öffentlichkeit und rechtswissenschaftlichen Diskussion gelangt. Oft wird dabei übersehen, dass ein großer Teil der von den neuen Straftatbeständen erfassten Verhaltensweisen bereits vor ihrer Einführung nach sozial- und krankenhausrechtlichen Regelungen unzulässig und sanktionsbewehrt war. Die vorliegende Arbeit widmet sich diesem bislang vernachlässigten Bereich und untersucht ausgewählte Kooperationsformen zwischen Vertragsärzten und Hilfsmittelerbringern respektive Krankenhäusern anhand der relevanten Vorschriften der §§ 73, 128 SGB V und § 31 a KHGG NRW. Der Autor zeigt deren Schwachstellen sowie Vorschläge zu ihrer Verbesserung und Ergänzung auf und erörtert die Frage nach der Notwendigkeit eines eigenständigen strafrechtlichen Regelungskomplexes für den Gesundheitssektor.
