Dieser Band fragt nach Georg Friedrich Puchtas Begriff des Rechts und seiner Auffassung von den Aufgaben des Juristen bei Erkenntnis und Anwendung des Rechts. Dabei lässt der Autor die unter dem Schlagwort »Begriffsjurisprudenz« bekannten stereotypen Bewertungen außen vor und bezieht die prägenden geistigen Auseinandersetzungen und Vorstellungen seiner Zeit ein. Ausgehend von Puchtas Wahrheits- und Wissenschaftsbegriff, der in vorrechtlichen Überzeugungen wurzelt, werden die Grundbegriffe seines Rechtsverständnisses entwickelt. For centuries, the starting points for serious thought about ethics, justice, and government were traditions founded, in China by Confucius, and in the West by his near contemporary Socrates. In both classical traditions, norms were based on human nature; to contravene these norms was to deny part of one's humanity. The Chinese and Western philosophical traditions have often been regarded as mutually unintelligible. This book shows that the differences can only be understood by examining where they converge. It describes the role of these traditions in two political achievements: the formation of the constitutions of Song dynasty China and the American Republic. Both traditions went into eclipse for similar reasons but with quite different consequences: in China, the growth of absolutism, and in the West, the inability of modern political and ethical thought to defend the most fundamental values.

Rudolf von Jhering (1818–1892) is one of the most popular German legal scholars of international renown. There has been no other legal scholar who tremendously and publicly celebrated the breach of his legal conceptions in the middle of his scientific career. Until today, it is unclear how and how far he has been the called interpreter of his own early conceptions. For this reason, the present work analyses published and unpublished writings, letters and posthumous documents in order to examine continuity and change of his conceptions on the notion of law and juristic methods in the contemporary context of pandectism and theoretical discussions.
