PRESENTAZIONE Il Primo Congresso Nazionale sui Domini collettivi presso la Società Tarquiniense d’Arte e Storia è stato frutto di un lungo progetto sviluppato in collaborazione con diversi istituti accademici nazionali ed esteri (tra i quali l’Universidad Católica de Murcia) e patrocinato dal Ministero per i Beni e le Attività culturali e per il Turismo. Lo scopo principale della Riunione scientifica è stato quello di costituire una nuova occasione di dibattito interdisciplinare sugli assetti fondiari collettivi, soprattutto dopo la svolta costituzionale aperta dalla Legge 168 del 20 novembre 2017. Diverse le ragioni che hanno portato all’iniziativa in terra etrusca. Anzitutto una ragione di ordine territoriale. Come noto, le occasioni più importanti e prestigiose di discussione scientifica in Italia sui Domini collettivi sono rappresentate dai convegni annuali organizzati dal Centro studi e documentazione sui demani civici e le proprietà collettive di Trento e dal Centro Studi “Guido Cervati” dell’Aquila. I suddetti istituti di ricerca, guidati rispettivamente da due autentici luminari degli assetti fondiari collettivi, i Professori Pietro Nervi e Fabrizio Marinelli, sono un costante punto di riferimento non solo accademico, ma anche centri di propulsione e diffusione di quella vera e propria rivoluzione culturale che ha portato alla legge sui domini collettivi del 2017. Il convegno di Tarquinia ha voluto pertanto, in piena sintonia e armonia con queste due pregevoli realtà, aprire una ulteriore occasione di riflessione scientifica sui domini collettivi che potesse riunire esperti e studiosi su un territorio con una sua identità specifica che, dal punto di vista delle proprietà collettive, è erede della tradizione storica delle province pontificie e, dal punto di vista gestionale, trova espressione nella realtà delle Università agrarie. Del resto, proprio le terre comuni dell’Italia centrale ed in particolare i folti boschi e le amene colline di Manziana furono il laboratorio giuridico ed esperienziale che portò nel 1894 ad una prima elaborazione, su iniziativa del Senatore manzianese Tommaso Tittoni, della categoria dei domini collettivi nei territori del debellato Stato pontificio. Una seconda ragione riguarda più specificamente l’istituto culturale che ha promosso l’iniziativa scientifica, la Società Tarquiniense d’Arte e Storia, secolare sodalizio di storia patria fondato nel 1917 dall’archeologo dai natali siciliani Giuseppe Cultrera e diretto attualmente dalla Dott.ssa Archeologa Alessandra Sileoni. La duplice natura (artistica e storica) del sodalizio ha conferito all’iniziativa una peculiare conformazione interdisciplinare con l’apertura, per esempio, alle Scienze archeologiche e artistiche che, certamente, presentano forti interconnessioni con il tema dei beni comuni. Le superbe torri e mura medievali della sede storica della società, inoltre, preservano quello che senza esagerazioni può essere definito un vero e proprio “archivio degli usi civici nello Stato pontificio”, composto di trenta grandi tomi con documenti pergamenacei e a stampa collocabili dagli inizi del secolo XVII sino agli anni 20 del XX. È una raccolta, finora poco conosciuta, di grande interesse soprattutto perché non è un affastellamento di fogli disordinato e disomogeneo, ma la catalogazione rigorosa e precisa di un vero protagonista della questione proprietaria nei territori di San Pietro: il Conte Casimiro Falzacappa, figura che ebbe un ruolo di primo piano nella stesura della Notificazione pontificia del 1849 sull’abolizione dei diritti di pascolo e quindi nelle politiche liberiste-abolizioniste che caratterizzano quel periodo storico. 10 Ebbene il Conte Casimiro Falzacappa organizzò il suo grande archivio sugli assetti fondiari collettivi in due grandi partizioni: da una parte, tutta la documentazione che fosse favorevole alla liquidazione degli usi civici, soprattutto i diritti di pascolo, dall’altra parte, le carte contrarie alla loro abolizione. Nei tomi contrari alla liquidazione degli usi civici sono custodite le voci innalzate con coraggio e veemenza dalle comunità locali come per esempio le memorie difensive inoltrate ai dicasteri pontifici, le suppliche umiliate al trono papale o ancora gli atti delle cause che per quasi un secolo vennero discusse innanzi alle varie istanze di giudizio, comprese quelle del periodo della repubblica romana. Scorrendo le carte dell’archivio si ha la prova di quanto fosse viva una coscienza collettiva delle terre comuni, patrimoni e spazi identitari che indubbiamente penetravano dal profondo del cuore quelle popolazioni che in esse riscoprivano la propria storia, una storia remota quanto le loro origini etrusche. Un’ultima annotazione concerne l’importanza di creare una proficua e fertile rete di relazioni tra le comunità di abitanti che amministrano le terre civiche e tutti coloro che per mandato accademico, professionale e soprattutto per il legame identitario con il proprio territorio vogliano tutelare gli spazi collettivi. La conferenza di Tarquinia, in questo senso, ha visto dialogare Professori universitari, Amministratori di beni collettivi, Magistrati, Professionisti e numerosi cittadini ed utenti delle terre comuni. Quando uscì la prima edizione, questo libro era il primo ad avere come soggetto una zona fino ad allora inesplorata e quasi del tutto trascurata dalla storiografia: l’alta Val di Cecina, una “terra incognita”. Fu un lavoro pionieristico che, inaspettatamente, rivelò una zona ricca di resti antichi e medievali. La curatrice dovette quindi confrontarsi con modelli insediativi fino ad allora poco definiti e con un passato seppellito dai profondi mutamenti che vi si erano avvicendati. Inoltre le rapide possibilità di accesso alle fonti archivistiche e bibliografiche tramite Internet – a cui oggi siamo abituati e assuefatti – erano all’epoca ben al di là da venire, come molte delle moderne tecnologie che consentono un migliore studio dell’archeologia globale di un territorio. Dopo trent’anni, molti spunti di ricerca, che avevano trovato per la prima volta espressione in questo volume, sono stati adottati e perseguiti da altri studiosi, che hanno sviluppato alcune delle tematiche proposte nella prima edizione. Qualche esempio fra i tanti: la definizione di sinecismo che sta alla base della genesi dei castelli di Radicondoli e di Belforte nel XII secolo e lo sviluppo urbanistico dei centri di nuova fondazione; i segni dei lapicidi incisi sulle murature della Pieve Vecchia, i primi segnalati e studiati nella Toscana centro-meridionale.

Originally published in 1966. The Individual and Society in the Middle Ages, based on three guest lectures given at Johns Hopkins University in 1965, explores the place of the individual in medieval European society. Looking at legal sources and political ideology of the era, Ullmann concludes that, for most of the Middle Ages, the individual was defined as a subject rather than a citizen, but the modern concept of citizenship gradually supplanted the subject model from the late Middle Ages onward. Ullmann lays out the theological basis of the political theory that cast the medieval individual as an inferior, abstract subject. The individual citizen who emerged during the late Middle Ages and the Renaissance, by contrast, was an autonomous participant in affairs of state. Several intellectual trends made this humanistic conception of the individual possible, among them the rehabilitation of vernacular writing during the thirteenth century and the growing interest in nature, natural philosophy, and natural law. However, Ullmann points to feudalism as the single most important medieval institution that laid the groundwork for the emergence of the modern citizen.

In the 1290s a new guild-based Florentine government placed a group of noble families under severe legal restraints, on the grounds that they were both the most powerful and the most violent and disruptive element in the city. In this colorful portrayal of civic life in medieval Florence, Carol Lansing explores the patrilineal structure and function of these urban families, known as "magnates." She shows how they emerged as a class defined not by specific economic interests but by a distinctive culture. During the earlier period of weaker civic institutions, these families built their power by sharing among themselves crucial resources--forts, political alliances, ecclesiastical rights. Lansing examines this activity as well as the responses patrilineal strategies drew from women, who were excluded from inheritance and full lineage membership.
