This book explores the extent of private companies’ freedom of action during the Nazi period through six case studies of different economic sectors. Since the mid-1990s, historical research has intensively discussed the role played by private, domestic and foreign enterprises during the ‘Third Reich’. Numerous case studies suggest that even under the extreme ideological circumstances of the ‘Third Reich’, the strategic decisions of private firms followed economic criteria. In fact, the regime was especially able to control the economy successfully in those cases in which it operated with economic incentives and gave companies room for manoeuvre. This scope, however, became increasingly smaller towards the end of the war due to increasing state intervention and government control. The chapters discuss this scope of action and relate it to the National Socialist crimes. This book was originally published as a special issue of Business History.

Classical liberalism has typically sought to maintain as much room as possible for the exercise of personal initiative in the face of the encroachment of states. This book explores these questions of coercion and authority in the context of the size and scope of the state and argues that the state and its agents should be held to the same moral rules as are the individuals it rules over. The book considers how a distinct feature of the state is its police or coercive power, about which one may ask how the state acquires it and what if anything would justify its use. It considers the implication that there is nothing inherent about state agents that entitles one to behave in ways that we would not accept from a private actor, and how once that argument is made, the state’s claim to authority is weakened. The author also discusses the extent to which democracy has been thought to provide any sort of justification for coercion or authority. This book will be of interest to academics and students of political philosophy, especially classical liberalism, and legal philosophy.

Economic sanctions are instruments of foreign policy. However, they can also affect legal relations between private parties – principally in contract. In such cases, the court or arbitration tribunal seized must decide whether to give effect to the economic sanction in question. Private international law functions as a 'filter', transmitting economic sanctions that originate in public law to the realm of private law. The aim of this book is to examine how private international law rules can influence the enforcement of economic sanctions and their related foreign policy objectives. A coherent EU foreign policy position – in addition to promoting legal certainty and predictability – would presuppose a uniform approach not only concerning the economic sanctions of the EU, but also with regard to the restrictive measures imposed by third countries. However, if we examine in detail the application of economic sanctions by Member States' courts and arbitral tribunals, we find a somewhat different picture. This book argues that this can be explained in part by the divergence of private international law approaches in the Member States.

Scott [1866-1943] presents a detailed and comprehensively documented history of the American Constitution from its roots in the Mayflower Compact and other colonial associations through the Eighteenth Amendment. It can be read in this regard as a survey history. His study is especially interesting, however, as a political document written to address the effects of the First World War. Scott wrote this book for a European audience, hoping that his analysis of the Constitution would influence the creation of an international organization of states governed by a "Court of Nations" modeled on the American Supreme Court. As such, he emphasizes the Constitution's role as an agent of peace and cooperation among different political units. Scott's ideas were later reflected in the establishment of the International Court of Justice, the League of Nations and the United Nations.
