Why are transactions involving trust managed in very different ways? In this inaugural lecture - delivered on the acceptance of the Chair of Empirical Legal Studies at the Erasmus School of Law, Erasmus University Rotterdam - Professor Vincent Buskens shows that contracts and other forms of regulation used in trust situations vary and depend on economic, psychological, social, and legal aspects of the transaction. The research on trust is used to demonstrate why legal scholars need to incorporate an interdisciplinary behavioral approach. Such an approach is necessary to reach a better understanding of the effects of changes in regulation on behavior of actors affected by the regulation. Those who exercise political power often feel they must act in ways that would otherwise be considered immoral: indeed, paradoxically, they sometimes feel that it would be immoral of them not to perform or condone such acts as killing or lying. John Parrish offers a wide-ranging account of how this important philosophical problem emerged and developed, tracing it - and its proposed solutions - from ancient Greece through the Enlightenment. His central argument is that many of our most familiar concepts and institutions - from Augustine's interiorised ethics, to Hobbes's sovereign state, to Adam Smith's 'invisible hand', understanding of the modern commercial economy - were designed partly as responses to the ethical problem of dirty hands in public life.

New York March,1956 INTRODUCTION One axiomatic premise of this study is that capitalism is an embodiment of Smithian principles. Hence the interpretation of Smith's teaching must also be an interpretation of capitalistic society. A second such premise is that it is at least as likely that Smith had a single view of existence that pervaded both his books as that he had two views of existence which contended in each of his books. Hence the possibility is not excluded that the tension of outlooks reflected in Smith's writings betokens not an inconsistency but an intention.

This book analyzes the conflict that emerges between parties after a breach of contract and how different legal remedies can best reduce conflict. Causes for conflict include equity, efficiency, and ethical reasons that parties might consider and use to blame the other or to justify breach. In the end, if not resolved through apologies or renegotiation, conflict leads to aggrievement and behavioral reactions in form of retaliation by the victim against the promisor in breach. The book provides empirical evidence from laboratory experiments for how individuals react to perceived wrongful acts such as breach of contract and for the function of legal remedies to reduce retaliation by disappointed promisees in providing them compensation. It reveals how the inequality in the outcome, and not the inefficiency of breach of contract, causes aggrievement and retaliation by victims.
