This is however a fairly recent development. Not long ago the provision of these services was reserved for few national public sector incumbents, who were often also entrusted with regulatory tasks. This development is interesting and notable in itself. However, equally or perhaps even more interesting, is the role played by competition law in the process. Most observers agree that competition law only played a limited role in this transformation due to the limited ability of competition law to address the special problems and complexity of the electricity and telecommunications sectors. These observations are based on perceived shortcomings in regulating these complex sectors of industry. As it will be demonstrated the observations are not only incorrect but also fail to do justice to the very active role played by competition law. Looking back on the process of liberalization that started more than 25 years ago, it is apparent that absent the 'sledgehammer' effect of its competition law tools, the EU Commission would have been significantly worse positioned in extending the internal market concept to the provision of electricity and telecommunication services. Arguably, the whole liberalization process would never have come about or would have taken a different direction. However, in this process competition law has been 'twisted' to a point of giving it a certain regulatory flavour. The purpose of this book is to develop the understanding of the liberalization process in its entirety including the role played by competition law. Moreover, some words of caution will be offered against expanding the application of competition law to these sectors further without careful consideration of the long term ramifications for the sectors and competition law."

A wave of liberalization swept the developed world at end of the twentieth century. From the 1970s and 1980s onwards, most developed countries have passed various measures to liberalize and modernize the financial markets. Each country had its agenda, but most of them have experienced, to a different extent, a change in regulatory regime. This change, often labeled deregulation and associated with the advent of neoliberalism, was sharply contrasting with the previous era of the Bretton Woods system, which has sometimes been portrayed as an era of financial repression. On the other hand, a quick glance at financial regulation today - at the amount of paper it produces, at its complexity, at the number of people involved, and at the resources invested in it - is enough to say that, somehow, there is more regulation today than ever before. In the new system, financial regulation has taken unprecedented importance. As more archival material is becoming available, a better understanding of the fundamental changes in the regulatory environment towards the end of the twentieth century is now possible. What kind of change exactly was deregulation? Did competition between financial regulators lead to a race to the bottom in regulation? The standard wisdom among political scientists has been that "iron triangles" operated among regulatory agencies, the regulated industries, and members of Congress, all presumably with a stake in preserving regulation that protected the industries from competition. Despite almost unanimous agreement among economists that such regulation was inefficient, it seemed highly unlikely that deregulation could occur. Yet between 1975 and 1980 major deregulatory changes that strongly favored competition did take place in a wide range of industries. The results are familiar to airline passengers, users of telephone service, and trucking freight shippers, among others. Martha Derthick and Paul J. Quirk ask why this deregulation happened. How did a diffuse public interest prevail over the powerful industry and union interests that sought to preserve regulation? Why did the regulatory commissions, which were expected to be a major obstacle to deregulation, instead take the initiative on behalf of it?
