It is too soon to judge (in history's full scope) the presidency of Barack Obama. An early verdict, though, would be less-than-glowing: pointing to a period of political stagnation in Washington and of a president's inability to successfully deliver on the promise of “change.” Whether one agrees or disagrees with the assessments laid out in the pages of this book, hopefully readers will put aside the name-calling and the venom of recent partisanship. It is hoped that “We the People” can agree in spirit while disagreeing on specific policy, and together begin a more open and honest discussion of the roads already traveled and the decisions we face looking forward. This cannot be done, though, unless and until Americans acknowledge the cracks and imperfections in the image Ronald Reagan painted of a “shining city on a hill.”

Cities around the world are undergoing profound changes. In this global era, we live in a world of rising knowledge economies, digital technologies, and awareness of environmental issues. The so-called "modern infrastructural ideal" of spatially and socially ubiquitous centrally-governed infrastructures providing exclusive, homogeneous services over extensive areas, has been the standard of reference for the provision of basic essential services, such as water and energy supply. This book argues that, after decades of undisputed domination, this ideal is being increasingly questioned and that the network ideology that supports it may be waning. In order to begin exploring the highly diverse, fluid and unstable landscapes emerging beyond the networked city, this book identifies dynamics through which a ‘break’ with previous configurations has been operated, and new brittle zones of socio-technical controversy through which urban infrastructure (and its wider meaning) are being negotiated and fought over. It uncovers, across a diverse set of urban contexts, new ways in which processes of urbanization and infrastructure production are being combined with crucial sociopolitical implications: through shifting political economies of infrastructure which rework resource distribution and value creation; through new infrastructural spaces and territorialities which rebundle socio-technical systems for particular interests and claims; and through changing offsets between individual and collective appropriation, experience and mobilization of infrastructure. Despite growing skepticism about the value of international law and its compatibility with state sovereignty, states should improve and strengthen international law because it makes a critical contribution to an international order characterized by peace and justice. In recent years, international agreements and institutions have become particularly contentious. China is refusing to abide by the decision of an international arbitration decision implementing UNCLOS rules in the South China Sea, and Donald Trump has withdrawn the US from international agreements including the Paris Agreement on Climate Change of 2015. Such retreats expose widespread ambivalence towards cooperation through international law, and reverse the gains made by long-standing processes of legalization. In Law Beyond the State, Carmen Pavel responds to the ambivalent attitude states have with respect to international law by offering moral and legal reasons for them to improve, strengthen, and further institutionalize its capacity. She argues that the same reasons which support the development of law at the domestic level, namely the cultivation of peace, the protection of individual rights, the facilitation of complex forms of cooperation, and the resolution of collective action problems, also support the development of law at the international level. The argument thus engages in institutional moral reasoning. Pavel shows why it should matter to individuals that their states are part of a rule-governed international order. When states are bound by common rules of behavior, their citizens reap the benefits. International law encourages states to protect individual rights and provides a forum where they can communicate, negotiate, and compromise on their differences in order to protect themselves from outside interference and pursue their domestic policies more effectively, including those directed at enhancing their citizen's welfare. Thus, Pavel shows that international law makes a critical, irreplaceable, and defining contribution to an international order characterized by peace and justice. At a time when challenges of cooperation beyond state boundaries include climate change, health epidemics, and large-scale human rights violations, Law Beyond the State issues a powerful reminder of the tools we have to address them.

Essential resources do more than satisfy people's needs. They ensure a dignified existence. Since the competition for essential resources, particularly fresh water and arable land, is increasing and standard legal institutions, such as property rights and national border controls, are strangling access to resources for some while delivering prosperity to others, many are searching for ways to ensure their fair distribution. This book argues that the division of essential resources ought to be governed by a combination of Voice and Reflexivity. Voice is the ability of social groups to choose the rules by which they are governed. Reflexivity is the opportunity to question one's own preferences in light of competing claims and to accommodate them in a collective learning process. Having investigated the allocation of essential resources in places as varied as Cambodia, China, India, Kenya, Laos, Morocco, Nepal, the arid American West, and peri-urban areas in West Africa, the contributors to this volume largely concur with the viability of this policy and normative framework. Drawing on their expertise in law, environmental studies, anthropology, history, political science, and economics, they weigh the potential of Voice and Reflexivity against such alternatives as pricing mechanisms, property rights, common resource management, political might, or brute force.

Today we have wandered away from His precepts, We the People have lost sight of these “Natural Law Principles” and so have our government servants. We have lost our way and the blessings of Liberty are all but lost. But I believe that if we look into the blessings that God has bestowed upon America, we will be humbled, for He promised that “If my people, which are called by my name, shall humble themselves, and pray, and seek my face, and turn from their wicked ways; then will I hear from heaven, and will forgive their sin, and will heal their land.” – 2 Chr 7:14;Thomas Jefferson said, “If a People expect to be ignorant and free, they expect what never was and never will be.” I believe that this book has the potential of waking up America.
