Regulatory change is typically understood as a response to significant crises like the Great Depression, or salient events that focus public attention, like Earth Day 1970. Without discounting the importance of these kinds of events, change often assumes more gradual and less visible forms. But how do we ‘see’ change, and what institutions and processes are behind it? In this book, author Marc Eisner brings these questions to bear on the analysis of regulatory change, walking the reader through a clear-eyed and careful examination of: the dynamics of regulatory change since the 1970s social regulation and institutional design forms of gradual change – including conversion, layering, and drift gridlock, polarization, and the privatization of regulation financial collapse and the anatomy of regulatory failure Demonstrating that transparency and accountability – the hallmarks of public regulation – are increasingly absent, and that deregulation was but one factor in our most recent significant financial collapse, the Great Recession, this book urges readers to look beyond deregulation and consider the broader political implications for our current system of voluntary participation in regulatory programs and the proliferation of public-private partnerships. This book examines patterns of environmental regulation in the European Union and four federal polities--the United States, Germany, Australia, and Canada. Daniel Kelemen develops a theory of regulatory federalism based on his comparative study, arguing that the greater the fragmentation of power at the federal level, the less discretion is allotted to component states. Kelemen's analysis offers a novel perspective on the EU and demonstrates that the EU already acts as a federal polity in the regulatory arena. In The Rules of Federalism, Kelemen shows that both the structure of the EU's institutions and the control these institutions exert over member states closely resemble the American federal system, with its separation of powers, large number of veto points, and highly detailed, judicially enforceable legislation. In the EU, as in the United States, a high degree of fragmentation in the central government yields a low degree of discretion for member states when it comes to implementing regulatory statutes. This book examines regulatory capacity beyond the nation state. It suggests that we can only understand why EU agencies are able to build EU regulatory capacity if we acknowledge that national regulators provide their expertise, staff and resources to the regulatory processes taking place in these EU bodies. This raises the puzzle of why national regulators are willing to provide 'life support' to potentially rival organisations. The book is devoted to answering this question in order to understand how EU regulatory capacity is created in the absence of a full supranational regulatory bureaucracy. To do so, the book studies to what extent national regulators from two countries (the UK and Germany) support EU agencies in their work across four policy sectors (drug safety, food safety, maritime safety and banking supervision). The book makes a significant contribution by developing a bureaucratic politics perspective that highlights the importance of national regulators for EU regulatory capacity building. Eva Heims is Lecturer in Public Policy at the University of York, UK. She is also a research associate at the Centre for the Analysis of Risk and Regulation, LSE, UK. For the first two thirds of the twentieth century, British government was among the most stable in the advanced industrial world. In the last three decades, the governing arrangements have been in turmoil and the country has been a pioneer in economic reform, and in public sector change. In this book, Michael Moran examines and explains the contrast between these two epochs. What turned Britain into a laboratory of political innovation? Britain became a formal democracy at the start of the twentieth century but the practice of government remained oligarchic. From the 1970s this oligarchy collapsed under the pressure of economic crisis. The British regulatory state is being constructed in its place. Moran challenges the prevailing view that this new state is liberal or decentralizing. Instead he argues that it is a new, threatening kind of interventionist state which is colonizing, dominating, and centralizing hitherto independent domains of civil society. The book is essential reading for all those interested in British political development and in the nature and impact of regulation.
