An analysis of how responsive governance has shaped the evolution of global fisheries in cyclical patterns of depletion and rebuilding dubbed the “management treadmill.” The oceans are heavily overfished, and the greatest challenges to effective fisheries management are not technical but political and economic. In this book, D. G. Webster describes how the political economy of fisheries has evolved and highlights patterns that are linked to sustainable transitions in specific fisheries. Grounded in the concept of responsive governance, Webster's interdisciplinary analysis goes beyond the conventional view of the "tragedy of the commons.” Using her Action Cycle/Structural Context framework, she maps long-running patterns that cycle between depletion and rebuilding in a process that she terms the management treadmill. Webster documents the management treadmill in settings that range from small coastal fishing communities to international fisheries that span entire oceans. She identifies the profit disconnect, in which economic incentives are out of sync with sustainable use, and the power disconnect, in which those who experience the costs of overexploitation are politically marginalized. She examines how these disconnects shaped the economics of expansion and documents how political systems failed to prevent related cycles of serial resource depletion. Webster also traces the increasing use of restrictive management in response to worsening fisheries crises and the emergence of new, noncommercial interests that demand greater management but also generate substantial conflict. She finds that the management treadmill is speeding up with population growth and economic development, and so concludes that sustainable fisheries can only exist within a sustainable global economic system.

This paper discusses the potential value of catch documentation schemes (CDS) in deep-sea fisheries, and the implementation aspects that have to be taken into account to ensure the effectiveness of this trade-based tool to combat illegal, unreported and unregulated (IUU) fishing. The paper argues that the schemes are indeed useful for addressing IUU fishing practices known to occur in deep-sea fisheries, and that their adoption would improve compliance with fisheries management requirements. Key infringements that could be directly detected and addressed include - but are not limited to - violations of closed areas harbouring protected vulnerable marine ecosystems in the deep ocean, and quota overfishing. The paper also establishes the notion that partial coverage of given species through a CDS at the level of regional fisheries management organizations is incongruous. Given that most deep-sea fisheries species have broad distributions that straddle many regional organizations, the most suitable implementation model appears to be a centrally operated electronic CDS platform - called a super-CDS - shared by a plurality of institutional and state players.

Large marine protected areas (MPAs) have emerged since the mid-2000s as a popular state response to the overfishing, land run-off, and climate change causing the decline of the world's oceans. As of 2020, there were more than 14,000 MPAs in the world, most of them small, poorly managed, and often amounting to little more than "paper parks" that contribute little to ocean conservation or resource management. However, that is beginning to change. In recent years, governments, including the United States and United Kingdom, have turned their attention to protecting large swaths of ocean through MPAs hundreds of thousands of square kilometers in size. In this book, Justin Alger documents the efforts of activists and states to increase the pace and scale of global ocean protections, leading to a paradigm shift in how states conserve marine biodiversity. Through an analysis of domestic political economies, and based on three original MPA case studies located in the United States, Australia, and Palau, this book explains how states have protected millions of square kilometers of ocean space while remaining highly responsive to the interests of businesses. From the commercial fishing to ecotourism sectors, business heavily influences conservation policy, occasionally leading to robust protections but more often than not to business-as-usual activity on the water. Conserving the Oceans examines the reach and the limits of business influence, examining how the domestic political economy of a given ocean space can reshape a global norm to better suit local economic realities. While recognizing important global progress and growing ambition to conserve ocean ecosystems, Alger provides a critical analysis of the processes by which global environmental norms become domestic policy. Ultimately, the book questions if we are still doing too little to prevent the worst impacts of the global environmental crisis despite the paradigm shift in global ocean conservation.

The 1982 United Nations Convention on the Law of the Sea (UNCLOS) remains the cornerstone of global ocean governance. However, it lacks effective provisions or mechanisms to ensure that all ocean space and related problems are dealt with holistically. With seemingly no opportunity for revision due to the Conventions burdensome amendment provisions, complementary mechanisms dealing with such aspects of global ocean governance including maritime transport, fisheries, and marine environmental sustainability, have been developed under the aegis of the United Nations and other relevant international organizations. This approach is inherently fragmented and unable to achieve sustainable global ocean governance. In light of the Sustainable Development Goals (SDGs), particularly Goal 14, the IMLI Treatise proposes a new paradigm on the basis of integrated and cross-sectoral approach in order to realise a more effective and sustainable governance regime for the oceans. This volume focuses on the role of UN as the central intergovernmental organization responsible for global ocean governance. It examines the ocean governance challenges and how the present legal, policy, and institutional frameworks of the UN have addressed these challenges.
