"Téngase en cuenta que el Derecho Administrativo está atravesando una fase de transición, que se presenta con singularidades; de una parte, siguen permaneciendo las estructuras autoritarias que se expresan en resoluciones administrativas; de otra, están emergiendo, de forma siempre más imperiosa, las estructuras convencionales. Esta evolución había sido prevista en la obra y ya se habían anticipado algunos marcos teóricos de la misma en el tratamiento, no tanto de los contratos de carácter público, cuanto en los otros tipos de acuerdos y contratos: contratos de objeto público, accesivos, sustitutivos, etc. La doctrina posterior ha tenido en cuenta estas indicaciones y las ha desarrollado. En este momento, el ámbito de la actuación de la administración que se desarrolla por acuerdos todavía se está dilatando, por lo que los asuntos más importantes son gestionados ya mediante procedimientos que comprenden una parte de carácter público, pero también una parte preponderante de naturaleza convencional. Por ello, una teoría general del Derecho Administrativo, que quiera ser fiel al tiempo en el que se vive, debe tener al mismo tiempo, estructuras dispositivas y estructuras convencionales". In Poverty: a philosophical approach, the author studies various philosophical issues concerning poverty in the Program for Education, Health and Food (PROGRESA) that was in effect in Mexico, from 1997 to 2002, and shows how theoretical discussion is necessary to clarify some ideas concerning the application of a social policy. Poverty is one of the main problems concerning economics, political philosophy, and ethics. It is an ethical problem because of its relationship with self-esteem. Since poverty is intimately related to social policies, the philosophy of poverty must consider the distribution criteria used to attend to people in situations of extreme poverty. This would involve attention to their needs, preferences, capabilities and “well-being” rights. The book considers social policies applied to poverty, and their occasional abuse of utilitarian instruments. Many are implemented without considering cultural differences, including varying patterns of conduct in diverse communities. Equality also matters. Since poverty and inequality are not the same, the study of the latter allows us to target groups found in the lowest levels of “the playing field”.

Esta obra pretende contribuir a una nueva ciudadana intercultural que suponga avanzar en la lgica inclusiva de la democracia segn las exigencias del principio de justicia. En el contexto actual de una globalizacin tremendamente injusta, la dinmica nihilista del mercado conlleva, con la exclusin de muchos, la negacin fctica de la dignidad humana. Frente a este nihilismo cultural que se difunde con la globalizacin capitalista, es preciso abrir brecha a favor de un discurso crtico que aliente, desde la verdad prctica como cuestin de justicia, la recuperacin del sentido de la accin poltica. La laicidad del Estado y de los mbitos pblicos de una sociedad secularizada y pluralista constituye otro de los temas candentes del debate poltico. Para impulsar la consolidacin de la laicidad, adems de recapacitar sobre los argumentos que histricamente se han dado a su favor, es necesario hacer un balance crtico desde el que repensar la religin y poner al da el laicismo. Finalmente, para clarificar el horizonte en el que se inscribe la pretensin de radicalizar el bienestar en trminos de justicia, es imprescindible replantear crticamente lo utpico, reubicarlo a la escala de la finitud humana y liberarlo de la mitificacin del progreso.

El debate académico reciente sobre la justicia distributiva se ha centrado en determinar la relevancia de la responsabilidad individual a la hora de especificar nuestras obligaciones mutuas como miembros de una sociedad. El calado teórico de esta cuestión justifica de por sí la atención que ha recibido por parte de los filosofos políticos. No obstante, el debate político fuera de la academia también ha contribuido a avivar la discusión filosófica sobre el tema. En los últimos años se ha impuesto un discurso conservador que aborda ciertos problemas sociales como la pobreza o la delincuencia poniendo énfasis en las elecciones, el esfuerzo, el estilo de vida y la responsabilidad de los individuos sobre estos males. Esta retórica ha sido utilizada para criticar el Estado del bienestar con el argumento de que sus políticas penalizan a quienes con esfuerzo y trabajo consiguen una posición de ventaja y son incapaces de distinguir entre los sujetos necesitados que realmente merecen ayuda, y los que deben soportar su desventaja porque son responsables de la misma. En el terreno político, la responsabilidad individual casi siempre ha sido invocada para justificar una disminución de los beneficios sociales para los más pobres, y un aligeramiento de las cargas que deben soportar los más ricos. ¿Es cierto que la responsabilidad menoscaba la igualdad? Una respuesta afirmativa a esta cuestión es una mala noticia para el igualitarismo ya que la idea de responsabilidad está fuertemente arraigada en nuestras intuiciones básicas sobre lo que es justo. Por esta razón, varios liberales igualitarios contemporáneos han tratado de importar la idea de responsabilidad al discurso filosófico en defensa de la igualdad. Su propósito es mostrar que, bien entendida, la responsabilidad justifica programas distributivos más generosos que los que existen hoy en día en nuestras sociedades. Este trabajo explora la incorporación y el desarrollo de la idea de responsabilidad en el seno del liberalismo igualitario.

First published in Spanish in 2006, Twenty Theses on Politics is a major statement on political philosophy from Enrique Dussel, one of Latin America’s—and the world’s—most important philosophers, and a founder of the philosophy of liberation. Synthesizing a half-century of his pioneering work in moral and political philosophy, Dussel presents a succinct rationale for the development of political alternatives to the exclusionary, exploitative institutions of neoliberal globalization. In twenty short, provocative theses he lays out the foundational elements for a politics of just and sustainable coexistence. Dussel first constructs a theory of political power and its institutionalization, taking on topics such as the purpose of politics and the fetishization of power. He insists that political projects must criticize or reject as unsustainable all political systems, actions, and institutions whose negative effects are suffered by oppressed or excluded victims. Turning to the deconstruction or transformation of political power, he explains the political principles of liberation and addresses matters such as reform and revolution. Twenty Theses on Politics is inspired by recent political transformations in Latin America.
