Grounded in Critical Race Theory (CRT), Black Men in Law School refutes the claim that when African American law students are "mismatched" with more selective law schools, the result is lower levels of achievement and success. Presenting personal narratives and counter-stories, Jackson demonstrates the inadequacy of the mismatch theory and deconstructs the ways race is constructed within American public law schools. Calling for a replacement to mismatch theory, Jackson offers an alternative theory that considers marginalized student perspectives and crystallizes the nuances and impact that historically exclusionary institutions and systems have on African American law school students. To further the debate on affirmative action, this book shows that experiences and voices of African American law school students are a crucial ingredient in the debate on race and how it functions in law schools.

“A wonderful excavation of the first era of civil rights lawyering.”—Randall L. Kennedy, author of The Persistence of the Color Line “Ken Mack brings to this monumental work not only a profound understanding of law, biography, history and racial relations but also an engaging narrative style that brings each of his subjects dynamically alive.”—Doris Kearns Goodwin, author of Team of Rivals Representing the Race tells the story of an enduring paradox of American race relations through the prism of a collective biography of African American lawyers who worked in the era of segregation. Practicing the law and seeking justice for diverse clients, they confronted a tension between their racial identity as black men and women and their professional identity as lawyers. Both blacks and whites demanded that these attorneys stand apart from their racial community as members of the legal fraternity. Yet, at the same time, they were expected to be “authentic”—that is, in sympathy with the black masses. This conundrum, as Kenneth W. Mack shows, continues to reverberate through American politics today. Mack reorients what we thought we knew about famous figures such as Thurgood Marshall, who rose to prominence by convincing local blacks and prominent whites that he was—as nearly as possible—one of them. But he also introduces a little-known cast of characters to the American racial narrative. These include Loren Miller, the biracial Los Angeles lawyer who, after learning in college that he was black, became a Marxist critic of his fellow black attorneys and ultimately a leading civil rights advocate; and Pauli Murray, a black woman who seemed neither black nor white, neither man nor woman, who helped invent sex discrimination as a category of law. The stories of these lawyers pose the unsettling question: what, ultimately, does it mean to “represent” a minority group in the give-and-take of American law and politics?

African-American Males and the Law analyzes the plight of African-American males in the United States and identifies how their status is directly or indirectly impacted by the justice system. The author initiates a dialogue on legal issues facing African-American males by addressing the stereotypical biases that African-American males face, and exposing the challenges surrounding their accessing the best possible education. He carefully delves into the legal aspects surrounding many of the popular biases and discriminations present in American society; including those surrounding employment and health care, and in particular within the legal system regarding treatment by police, in the courtroom, and within prisons. The author depicts the adverse and disproportionate impact of the American justice system on African-American males, since it seems that at each step of the system from arrest, incarceration and sentencing, to the death penalty, black males appear to be selectively prosecuted without conscience, remorse, or constitutional protection.

A groundbreaking anthology of essays providing commentary on gender and sexuality inclusion in the antiracist movement In late 1995, the Million Man March drew hundreds of thousands of black men to Washington, DC, and seemed even to skeptics a powerful sign not only of black male solidarity, but also of black racial solidarity. Yet while generating a sense of community and common purpose, the Million Man March, with its deliberate exclusion of women and implicit rejection of black gay men, also highlighted one of the central faultlines in African American politics: the role of gender and sexuality in antiracist agenda. In this groundbreaking anthology, a companion to the highly successful Critical Race Feminism, Devon Carbado changes the terms of the debate over racism, gender, and sexuality in black America. The essays cover such topics as the legal construction of black male identity, domestic abuse in the black community, the enduring power of black machismo, the politics of black male/white female relationships, racial essentialism, the role of black men in black women's quest for racial equality, and the heterosexist nature of black political engagement. "Featuring work by Cornel West, Huey Newton, Henry Louis Gates, Jr., A. Leon Higginbotham, Jr., Houston Baker, Marlon T. Riggs, Dwight McBride, Michael Awkward, Ishmael Reed, Derrick Bell, and many others, Devon Carbado's anthology stakes out new territory in the American racial landscape."—Critical America, A series edited by Richard Delgado and Jean Stephancic
