This book employs methods from comparative law to analyze voluntary migration, exploring the free movement of immigrants and their freedom of settlement under Brazilian and Mercosul law, as well as under German law and the European Union’s legal framework on migration. It discusses the level of protection granted to immigrants in terms of their right to enter and stay in Brazil and Mercosul, using German legislation and the EU’s legal framework on migration for comparison. Accordingly, the book will help migration researchers to understand not only the structure and rationale of migration law in Brazil, especially after the entry into force of its recent Migration Law in 2017, but also its relation to EU and German provisions on voluntary migration. It demonstrates how the differing natures of the migration law adopted by Brazil and Germany have led to different approaches and, consequently, different levels of protection for immigrants.

Brazilian immigration policy faced some deep changes in the last few years due to the development of a new legal system regarding this matter. The previous migration law date back from the 1980s, during a totalitarian civil-military regime and, despite the rebirth of democracy in 1988, this law remained in place for almost four decades. Because of that historical moment, the past immigration policy was focused on national public security and economic development. In contrast, the current law established human rights as one of the principles and guidelines of the Brazilian migration policy. Therefore, this book debates the extent to which a shift in the immigration law in Brazil has happened, moving away from the perspective of immigrants as threats towards seeing them as subjects of rights.

This book emerges from those fruitful discussions as a collection of some of the matters presented, whose authors have virtuously stood out. We are thankful to Transnational Press London as it believed in our aspirations as editors and it stimulated us to be protagonists in the process of editing and building up this book the way we believed it would contribute to the current discussions on migration. As scholars and young researchers, we are delighted by this opportunity created by Professor Sirkeci. “International migration is one of the most challenging and critical factors shaping the future of societies and economies today. Its accumulated complexity challenges academics, politicians, professionals and citizens. Bringing together the voices of authors from diverse countries and backgrounds, belonging to a new generation of researchers, this book brings new clues to understand how modern policies are built and new tools to act for a better world.” – João Peixoto, Lisbon School of Economics and Management (ISEG), Universidade de Lisboa, Portugal Contents INTRODUCTION Emília Lana de Freitas Castro and Sergio Maia Tavares Marques CHAPTER 1. It is also worth mentioning that each year more than 5 million people visit Brazil. What are your rights if things go wrong in a restaurant or in a hotel? How to make payment in Brazil? In order to answer these and other questions, the authors, both lawyers, wrote this guide, taking the opportunity to inform, in a practical way the rules and procedures to follow in several occasions during your stay in Brazil

Bachelor Thesis from the year 2018 in the subject Law - Criminal process, Criminology, Law Enforcement, grade: 10.0, Rutgers The State University of New Jersey - Newark (School of Criminal Justice), course: Honor's Thesis, language: English, abstract: This thesis will explore the phenomenon of immigrants bringing crime into America on a micro level. The study points out that the undocumented Brazilian community living in the city of Newark, NJ are rarely involved with crimes. In fact, their strong familial ties, cultural background and eagerness to work have potentially helped to lessen the crime rates in their neighbourhoods. The research question and objective of this study is to answer the question whether does the undocumented Brazilian community living in Newark make crime rates worse? The present research is focused on the city of Newark because the city provides a snapshot that paints the bigger picture of what happened in America. While the population of immigrants was increasing, the crime rates were dropping. According to the U.S. Census of 2010-2014, the city is the most populous in the state of New Jersey. Historically, Newark is known for its violent crimes, but more recently for its cultural revival and significant drop on the crime rates. The relationship between immigration and crime has been debated for over decades, but it was not until recently that this idea started driving public policies; restricting visas, banning international entry, and strengthening border enforcement and now separating children from their families crossing the border illegally. But it is irrefutable that immigration policies should be driven by data, empirical evidence, and foreign relations practices; not by a sociological myth that perceives every undocumented immigrant as a criminal individual.

Refugee Protection In Brazil And Latin America Selected Essays written by Liliana Lyra Jubilut and has been published by Transnational Press London this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-05-05 with Law categories.

Refugees and their protection have started to be a part of daily conversation in recent years. New flows from Africa to Europe, new crisis in Asia and in the Americas, and record numbers since the Second World War, for instance, have paved the way for news reports in the media, political discourses on the topic and debates on how to actually protect these persons. In a world scenario of increasingly (i) closed borders, (ii) association of migration to security issues, (iii) lack of political will to ascertain human rights and (iv) disregard for migration as a right in se, the challenges on and for refugees’ protection have been progressing; as have the need for international protection of persons fleeing well-founded fear of persecution due to their race, religion, nationality, political opinion or membership to a social group, i.e. refugees. Regional approaches and national practices gain relevance, especially if they can be seen as good practices, even if not without flaws. “What are the main challenges and opportunities regarding Refugee Protection in Latin America and in Brazil? The book offers a very convincing response. The essays by Liliana Jubilut reflect rigorous academic research and years of practical experience on supporting asylum seekers and refugees. The author is certainly one of the most influential scholars in Brazil working in the Forced Migration field, and the essays provide a comprehensive view of Refugee Protection in Brazil and Latin America”. – Gabriel Gualano de Godoy, PhD, UNHCR Chief of Mission in the Dominican Republic and former Head of UNHCR Protection Unit in Brazil. “This book shed clear lights on the development of refugee protection in Latin America for the years to come. Liliana Jubilut is already a leading scholar on refugee protection in Latin America and her articles reflect a long myriad of issues related to refugee protection, since status determination, resettlement, local integration and the remarkable humanitarian visas for the Syrian refugees. She shows the developments and setbacks and recover the most important developments since the Cartagena Declaration with a sharp eye and historical perspective. This book will soon become an essential bibliography for anyone trying to understand the particular and innovative refugee protection initiatives in this troubled but generous region”. – Wellington Pereira Carneiro, PhD, UNHCR Senior Official (having worked in Brazil and Colombia for UNHCR and in Panama prior to joining the UN)
