"The Dutch colonial power in Indonesia in the nineteenth century needed to clarify its understanding of the legal values and conventions of the peoples whom it claimed to rule. Dutch colonial lawyers tended to rationalize this legal culture, lumping together all kinds of indigenous legal customs from different areas as manifestations of adatrecht, or, customary law. The status of this legal system vis-a-vis Dutch colonial law was a source of continual depute and disagreement. The champions of adatrecht known as the Leiden School, with C. van Vollenhoven in the forefront, scored a victory around 1927 when adatrecht gained official recognition, though on the other hand it became the subject of mounting criticism. After World War II, the independent state of Indonesia paid lip service to adatrecht principles, but in practice treated it as irrelevant, or even an embarrassment."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. Becoming Better Muslims written by David Kloos and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-11-28 with Social Science categories.

How do ordinary Muslims deal with and influence the increasingly pervasive Islamic norms set by institutions of the state and religion? Becoming Better Muslims offers an innovative account of the dynamic interactions between individual Muslims, religious authorities, and the state in Aceh, Indonesia. Relying on extensive historical and ethnographic research, David Kloos offers a detailed analysis of religious life in Aceh and an investigation into today’s personal processes of ethical formation. Aceh is known for its history of rebellion and its recent implementation of Islamic law. Debunking the stereotypical image of the Acehnese as inherently pious or fanatical, Kloos shows how Acehnese Muslims reflect consciously on their faith and often frame their religious lives in terms of gradual ethical improvement. Revealing that most Muslims view their lives through the prism of uncertainty, doubt, and imperfection, he argues that these senses of failure contribute strongly to how individuals try to become better Muslims. He also demonstrates that while religious authorities have encroached on believers and local communities, constraining them in their beliefs and practices, the same process has enabled ordinary Muslims to reflect on moral choices and dilemmas, and to shape the ways religious norms are enforced. Arguing that Islamic norms are carried out through daily negotiations and contestations rather than blind conformity, Becoming Better Muslims examines how ordinary people develop and exercise their religious agency.

Muslims Through Discourse written by John R. Bowen and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-11-10 with Social Science categories.

In this rich account of a Muslim society in highland Sumatra, Indonesia, John Bowen describes how men and women debate among themselves ideas of what Islam is and should be--as it pertains to all areas of their lives, from work to worship. Whereas many previous anthropological studies have concentrated on the purely local aspects of culture, this book captures and analyzes the tension between the local and universal in everyday life. Current religious differences among the Gayo stem from debates between "traditionalist" and "modernist" scholars that began in the 1930s, and reveal themselves in the ways Gayo discuss and perform worship, sacrifice, healing, and rites of birth and death, all within an Islamic framework. Bowen considers the power these debates accord to language, especially in arguments over spells, rites of farming, hunting, and healing. Moreover, he traces in these debates a general conception of transacting with spirits that has shaped Gayo practices of sacrifice, worship, and aiding the dead. Bowen concludes by examining the development of competing religious ideas in the highlands, the alternative ritual forms and ideas they have pro-mulgated, and the implications of this phenomenon for the emergence of an Islamic public sphere.

Legal Pluralism In The Arab World written by Badouin Dupret and has been published by BRILL this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-03-20 with Law categories.

Legal pluralism denotes both the multiple social fields which produce partilly interacting norms and the state's recognition of the many sources of law which constitute its legislation. It advocates a break from traditional legal theory in favour of describing the law from a more sociological and anthropological perspective. The theory of legal pluralism proves a useful tool, offering a challenging avenue for the examination of socio-legal activities. Too often, however, the literature on legal pluralism has failed to place sufficient emphasis on its fundamental theoretical questions. The result of a seminar held in Cairo in December 1996 with contributions by sociologists, anthropologists, political scientists, legal theoreticians, and practising lawyers, Legal Pluralism in the Arab World represents the first comprehensive examination of this phenomenon. This collection of essays attempts to define the notion of legal pluralism from a sociological, anthropological, and theoretical perspective and highlights its connection with particular Arab societies and countries. The work's unique features include * a preface by John Griffiths, one of the most significant voices in the formulation of the theory of legal pluralism; * a broad range of case studies, demonstrating the diversity in formulations of the theory; and * a wide variety of approaches to the subject matter. Legal Pluralism in the Arab World is the only work in existence which addresses the concept of legal pluralism in this particular part of the world in such a systematic manner. These essays significantly enrich the current canon on legal pluralism and offer the reader a unique example of its richness and usefulness.
