Schon mittelalterliche scholastische Denker wie Thomas von Aquin und Bonaventura bezeichneten die 10 Gebote der Bibel als Naturgesetze. Doch kann man wirklich davon sprechen? Naturgesetze beanspruchen, allgegenwärtig und für jeden geltend zu sein. In Anbetracht der vielen verschiedenen Religionen aber, mit all ihren unterschiedlichen Weltbildern und Riten, die heute existieren, kann man diese These jedoch verwerfen. Die Bibel predigt, dass man nur einen Gott anbeten darf: „Ich bin der Herr, dein Gott, du sollst keine anderen Götter haben neben mir“. Im Buddhismus dagegen verhält es sich ganz anders. Obwohl er die Existenz der Götter nicht leugnet, so räumt er ihnen doch keine besondere Bedeutung ein. Sie sind nicht Schöpfer des Universums und haben auch keine Macht über das menschliche Schicksal. Wichtig ist allein, den richtigen Weg zu erkennen. Auch die alten Griechen kannten nicht den einen Gott, sie hatten eine größere Anzahl von Göttern und anderen Wesen, welche die Naturkräfte beherrschten, auch enthält die griechische Mythologie keine Offenbarungen oder spirituellen Lehren im Gegensatz zum Judentum oder dem Hinduismus. Dies alles also kann kein Kriterium einer Religion sein, es muss ein anderes existieren. Einen wichtigen Beitrag dazu leistet der französische Soziologe Emile Durkheim. Er versucht, dem Wesen den Religionen ein Stück näher zu kommen, indem er die Gründe für die wesentlichen Formen religiösen Denkens und Handelns bestimmen will. Er stellt dabei fest, dass alle Religionen in gewisser Hinsicht ähnlich sind, trotz ihrer verschiedenen Formen, weil sie alle von ein und derselben Gattung abstammen. Es muss notwendigerweise wichtige Elemente geben, die alle gemeinsam haben, und diese bilden den objektiven Gehalt von Religionen. Religionen variieren und verändern sich, sie existieren nur im Kollektiv und kommen nur in diesem zu Stande, sind demnach gesellschaftlich konstituiert. Doch Durkheim stellt fest, dass sie auch die Wirklichkeit ausdrücken, nämlich insofern, als sich hinter den Symbolen immer wirkliche menschliche Bedürfnisse verbergen. Im christlichen Ritual der Taufe beispielsweise soll der Gläubige durch Wasser in die Gemeinde aufgenommen werden und (nach katholischer Lehre) auch von der Erbsünde befreit werden. Obwohl diese beiden Symbole, Wasser und Erbsünde, in keinem konkreten Zusammenhang stehen, wird so ein Gemeinschaftsgefühl ausgedrückt, welches dem Menschen erlaubt, sich zu identifizieren und von anderen abzugrenzen, ein wichtiger Aspekt im gesellschaftlichen Leben. Zwei der großen Weltreligionen will ich in dieser Arbeit betrachten und ihre verschiedenen Lehren unter Anwendung der Durkheims Theorie erläutern: wo genau findet man den gemeinsamen Ausgangspunkt der Religionen. Verbirgt sich hinter all den Riten, Lehren und Glaubenvorstellungen eine gemeinsame Wirklichkeit, das heißt wirkliche und allen Menschen gemeinsame Bedürfnisse? Welche menschlichen Gefühle, Sehnsüchte und Grundvorstellungen verbergen sich dahinter? Wie wird folglich der „objektive Gehalt“ bei bestimmten Religionen heute sichtbar? Dies soll das Thema meiner Arbeit sein.

This volume considers the problem of legal universals at the level of the rule of law and human rights, which have fundamentally different pedigrees, and attempts to come to terms with the new unease arising from the universal application of human rights. Given the juridicization of human rights, rule of law and human rights expectations have become significantly intertwined: human rights are enforced with the instruments of the rule of law and are thus limited by the restricted reach thereof. The first section of this volume considers the difficulties of universalistic claims and offers a number of possible solutions for adapting universal expectations to specific contexts. The second section considers problems of human rights politics; sections three and four present empirical studies about the appearance and disappearance of the rule of law and fundamental rights in Western and non-Western societies. Special attention is paid to the problems of developing countries, with a specific focus on past and present developments in Iran. These empirical studies indicate that the acceptance of human rights and the rule of law is historically contingent and cannot simply be considered as a matter of culture.
