After the collapse of the Soviet bloc, there are only five socialist or communist countries left in the world China, Cuba, Laos, North Korea, and Vietnam which constitute about one-quarter of the world's population. Yet, there is little scholarship on their constitutions. These countries have seen varying socioeconomic changes in the decades since 1991, which have led in turn to constitutional changes. This book will investigate, from a comparative and interdisciplinary perspective, how and why the constitutional systems in these five countries have changed in the last three decades. The book then breaks the constitutional changes down into four questions: what are the substantive contents of constitutional change, what are the functions, what are the mechanisms, and what are the driving forces? These questions form a framework to process the changes the five countries have gone through, such as making new constitutions, amending current ones, introducing more rights, allowing citizens to engage in changes, enacting legislation, and defining the constitutional authority of the three state branches and their relationship with the Communist Party. While all five countries have adapted their constitutional systems, the degree, mechanisms, and influential factors are not identical and present considerable variations. This book examines and explores these differences and how they developed. Constitutional Change in the Contemporary Socialist World offers a comprehensive and holistic view of an understudied and overlooked area of constitutional law, essential for anyone studying or working in law, politics, or policy.

More than a quarter of century after the end of the war in 1975, the Lao leadership is still in search for a compelling nationalist narration. Its politics of culture and representation appear to be caught between the rhetoric of preservation and the desire for modernity. Meanwhile, originating from the periphery where ethnic minorities had hitherto been symbolically, politically and administratively confined, the participation of some of their members in the Indochina Wars (1945-75) exposed these individuals to socialization and politicization processes. This rigorously researched and cogently argued book is a fine-grained analysis of substantial ethnographic material, showing the politics of identity, the geographies of memory and the power of narratives of some members of ethnic minority groups who fought during the Vietnam War in the Lao People's Liberation Army and/or were educated within the revolutionary administration. No study has ever been conducted on the latter's views on the national(ist) project of the late socialist era. Their own perceptions of their membership of the nation have been overlooked. Post-War Laos is a set to be a landmark study, and an original contribution which refines established theories of nationalism, such as Anderson's 'imagined community', by addressing a common weakness: namely, their tendency to deny agency to individuals, who in fact interpret their relationship to, and place within, the nation in a variety of ways that may change according to time and circumstance.

This pioneering study of the fate of Buddhism during the communist period in Cambodia puts a human face on a dark period in Cambodia’s history. It is the first sustained analysis of the widely held assumption that the Khmer Rouge under Pol Pot had a centralized plan to liquidate the entire monastic order. Based on a thorough analysis of interview transcripts and a large body of contemporary manuscript material, it offers a nuanced view that attempts to move beyond the horrific monastic death toll and fully evaluate the damage to the Buddhist sangha under Democratic Kampuchea. Compelling evidence exists to suggest that Khmer Rouge leaders were determined to hunt down senior members of the pre-1975 ecclesiastical hierarchy, but other factors also worked against the Buddhist order. Buddhism in a Dark Age outlines a three-phase process in the Khmer Rouge treatment of Buddhism: bureaucratic interference and obstruction, explicit harassment, and finally the elimination of the obdurate and those close to the previous Lon Nol regime. The establishment of a separate revolutionary form of sangha administration constituted the bureaucratic phase. The harassment of monks, both individually and en masse, was partially due to the uprooting of the traditional monastic economy in which lay people were discouraged from feeding economically unproductive monks. Younger members of the order were disrobed and forced into marriage or military service. The final act in the tragedy of Buddhism under the Khmer Rouge was the execution of those monks and senior ecclesiastics who resisted. It was difficult for institutional Buddhism to survive the conditions encountered during the decade under study here. Prince Sihanouk’s overthrow in 1970 marked the end of Buddhism as the central axis around which all other aspects of Cambodian existence revolved and made sense. And under Pol Pot the lay population was strongly discouraged from providing its necessary material support. The book concludes with a discussion of the slow re-establishment and official supervision of the Buddhist order during the People’s Republic of Kampuchea period.
