How does a popular uprising transform itself from the disorder of revolution into a legal system that carries out the daily administration required to govern? Americans faced this question during the Revolution as colonial legal structures collapsed under the period’s disorder. Yet by the end of the war, Americans managed to rebuild their courts and legislatures, imbuing such institutions with an authority that was widely respected. This remarkable transformation came about in unexpected ways. Howard Pashman here studies the surprising role played by property redistribution—seizing it from Loyalists and transferring it to supporters of independence—in the reconstruction of legal order during the Revolutionary War. Building a Revolutionary State looks closely at one state, New York, to understand the broader question of how legal structures emerged from an insurgency. By examining law as New Yorkers experienced it in daily life during the war, Pashman reconstructs a world of revolutionary law that prevailed during America’s transition to independence. In doing so, Pashman explores a central paradox of the revolutionary era: aggressive enforcement of partisan property rules actually had stabilizing effects that allowed insurgents to build legal institutions that enjoyed popular support. Tracing the transformation from revolutionary disorder to legal order, Building a New Revolutionary State gives us a radically fresh way to understand the emergence of new states.

State Building in Revolutionary Ukraine examines six attempts to create governments on Ukrainian territories between 1917 and 1922. Focusing on how political leaders formed and staffed administrations, this study shows that in Ukraine during this time, there was an available pool of able administrators sufficiently competent in Ukrainian to work as bureaucrats in the independent national governments. These people could sometimes implement policies, a significant accomplishment in light of the upheavals of the time. Stephen Velychenko compares Ukrainian efforts to create an independent national government with the analogous successful efforts made in Russia, Poland, Ireland and Czechoslovakia. He questions the notion that Ukrainian attempts at national independence failed because its society was 'incomplete' and its leaders unable to organize an effective administration. Pointing out that Bolshevik administrations at the time were no more effective in implementing policies than their rivals, Velychenko argues that more effective governance was not one of the reasons for the Russian Bolshevik victory in Ukraine.

This book is a comprehensive overview and analysis of the Palestinians' travail as they move from revolutionary movement to state. Barry Rubin outlines the difficulties in the transition now under way arising from Palestinian history, society, and diplomatic agreements. He writes about the search for a national identity, the choice of an economic system, and the structure of government. Rubin finds the political system interestingly distinctive--it appears to be a pluralist dictatorship. There are free elections, multiple parties, and some latitude in civil liberties. Yet there is a relatively unrestrained chief executive and arbitrariness in applying the law because of restraints on freedom. The new ruling elite is a complex mixture of veteran revolutionaries, heirs to large and wealthy families, professional soldiers, technocrats, and Islamic clerics. Beyond explaining how the executive and legislative branches work, Rubin factors in the role of public opinion in the peace process, the place of nongovernmental institutions, opposition movements, and the Palestinian Authority's foreign relations--including Palestinian views and interactions with the Arab world, Israel, and the United States. This book is drawn from documents in Arabic, Hebrew, and English, as well as interviews and direct observations. Rubin finds that, overall, the positive aspects of the Palestinian Authority outweigh the negative, and he foresees the establishment of a Palestinian state. His charting of the triumphs and difficulties of this state-in-the-making helps predict and explain future dramatic developments in the Middle East.

What were the intentions of the Founders? Was the American constitution designed to protect individual rights? To limit the powers of government? To curb the excesses of democracy? Or to create a robust democratic nation-state? These questions echo through today's most heated legal and political debates. In this powerful new interpretation of America's origins, Max Edling argues that the Federalists were primarily concerned with building a government that could act vigorously in defense of American interests. The Constitution transferred the powers of war making and resource extraction from the states to the national government thereby creating a nation-state invested with all the important powers of Europe's eighteenth-century "fiscal-military states." A strong centralized government, however, challenged the American people's deeply ingrained distrust of unduly concentrated authority.
