Contracts for Infrastructure Projects: An International Guide provides a guide to the law relating to construction contracts for infrastructure projects; it is intended for the use of engineers and other professionals who are involved in the negotiation and administration of construction contracts, to enable them to understand the risks involved, and how to minimise them. The principles of construction law outlined in this book apply to small construction contracts as well as very large contracts for which the contract sum may be in the billions of dollars. The focus of the book is on construction contracts entered into by commercial organisations operating in a business environment. Contract law generally assumes that such parties are of equal bargaining power and puts relatively few fetters on their ability to agree on the terms of their bargain. However, where legislation impacts on the execution of construction projects or the operation of construction contracts it may be of major importance in protecting the rights of weaker parties or third parties. Today, climate change is among the most hotly-debated topics. The Clean Development Mechanism (CDM), one of the three financial mechanisms under the Kyoto Protocol open to developing and developed countries, was devised to assist in mitigation of global warming. This book discusses what China should do to make full use of the CDM to promote sustainable development and to meet the challenge of climate change from a legal perspective. The findings lead to the conclusion that the CDM has limitations in promoting sustainable development in China, and thus should be regarded only as a complementary instrument in combating climate change. Legal strategies for improving the implementation of CDM projects under the legal framework in China are thus put forward, and some proposals for China to meet the challenge of climate change in the post-2012 era are made. This book offers new insights to academics and policymakers both in the public and private sector. China has emerged as a dominant power in Eurasian affairs that not only exercises significant political and economic power, but increasingly, ideational power too. Since the founding of the People’s Republic, Chinese Communist Party leaders have sought to increase state capacity and exercise more effective control over their western frontier through a series of state-building initiatives. Although these initiatives have always incorporated an international component, the collapse of the USSR, increasing globalization, and the party’s professed concerns about terrorism, separatism, and extremism have led to a region-building project in Eurasia. Garcia traces how domestic elite-led narratives about security and development generate state-building initiatives, and then region-building projects. He also assesses how region-building projects are promoted through narratives of the historicity of China’s engagement in Eurasia, the promotion of norms of non-interference, and appeals to mutual development. Finally, he traces the construction of regions through formal and informal institutions as well as integrative infrastructure. By presenting three phases of Chinese domestic state-building and region-building from 1988-present, Garcia shows how region-building projects have enabled China to increase state capacity, control, and development in its western frontier.
