Myanmar's Constitution of 2008 was the 'road map' for the reform process that began in 2011. Despite extensive criticism of this Constitution for its emphasis on the role of the military, much progress has been made towards constitutional government and law reform. With the election of the opposition NLD to government in the general election of November 2015 and the presidential electoral college election of March 2016,now is the time to consider the Constitution, and prospects and needs for constitutional change as Myanmar moves towards democracy and the rule of law. Much has been made of the Constitution's rigidity, which is seen as an obstacle to reform and inconsistent with embracing the rule of law, human rights and multi-party democracy, especially with a rapidly transforming state and society. The Myanmar military has dominated that complex country for most of the period since independence in 1948. The fourth coup of 1 February 2021 was the latest by the military to control those aspects of society it deemed essential to its own interests, and its perception of state interests. The military’s institutional power was variously maintained by rule by decree, through political parties it founded and controlled, and through constitutional provisions it wrote that could not be amended without its approval. This fourth coup seems a product of personal demands for power between Senior General Min Aung Hlaing and Aung San Suu Kyi, and the especially humiliating defeat of the military-backed party at the hands of the National League for Democracy in the November 2020 elections. The violent and bloody suppression of widespread demonstrations continues, compromise seems unlikely, and the previous diarchic governance will not return. Myanmar’s political and economic future is endangered and suppression will only result in future outbreaks of political frustration.

A liberalization of economic policies has inspired considerable economic growth and encouraged the development of Burma's natural resources, but, according to David Steinberg, the current military government is akin to previous civilian governments in its commitment to socialism as a vehicle for development. The economic flexibility demonstrated by the government has not been matched by political liberalization, and as a result, economic growth remains a captive of administrative and policy constraints. Steinberg traces the origins and acceptance of socialist thought and planning in Burma and shows how socialist ideology has had to be tempered with pragmatism in order to make economic development possible. Looking to Burma's future, he also points out two central problems facing the country: strained minority relations, which have kept the nation from developing a sense of unity, and difficulties with political succession brought on by the military regime's preoccupation with perpetuating its own leadership.
