Este texto describe empírica y técnicamente las formas de legitimación legal diseñadas por el Estado colombiano para lograr incluir en el cumplimiento normativo a aquellos mineros que por diversas razones no atienden los requisitos impuestos. La obra está dividida en tres capítulos: en el primero se realiza una exposición sobre la posible clasificación de la minería para mostrar las diferentes formas de observar a las personas que se dedican a esta actividad, trayendo entonces a colación la minería legal y la ilegal, la formal y la informal, la categorización según la propiedad de los recursos, su tamaño (subsistencia, pequeña, mediana y gran minería), y terminando con unas breves palabras sobre la minería tradicional, la artesanal y otras; el segundo capítulo presenta los requisitos generales que el ordenamiento jurídico le ha impuesto a la actividad minera, tratándose este aparte de una extensión de lo ya sustentando por el mismo autor y otros en el libro La minería en páramos, humedales y reservas forestales; y finalmente en el tercer capítulo se presentan las formas de legitimación existentes, donde se tratarán las áreas de reserva especial, los procesos de legalización de la minería tradicional, los procesos de legalización de la minería de hecho y los subcontratos, entre otros temas.

El modelo de desarrollo altamente dependiente de recursos naturales tanto renovables como no renovables ha devenido en conflictos ambientales antes, durante y después de la obtención y el aprovechamiento de estos. Igualmente, las alarmas generadas por la comunidad científica, académica y civil sobre el agotamiento en cantidad y calidad del ambiente por culpa de actividades antrópicas y su impacto en los distintos ecosistemas, la fauna, la flora y en la supervivencia misma de los seres humanos llevaron a generar un andamiaje normativo que blindara ecosistemas de especial importancia ecológica por medio de usos del suelo que permitan garantizar la funcionalidad de los servicios ecosistémicos prestados por estos. De ahí que se crearan áreas protegidas con usos del suelo determinados en algunos casos obviando que en estas áreas existen asentamientos humanos de comunidades étnicas, campesinas y rurales, cuyas costumbres y usos del suelo pueden ir en contravía de los usos permitidos. Bajo esa tesitura, este libro aborda parte de las tensiones existentes entre el estilo de vida de las comunidades asentadas en el páramo de Ocetá y los usos del suelo permitidos en este imponente lugar por medio de la caracterización de los conflictos ambientales existentes, y a partir de ello esbozar una propuesta para atender tales conflictos desde la administración, gestión y justicia ambiental.
