The grain handling and transportation system in Canada (GHTS) is currently going through a major transition, both with respect to handling and transportation. Historically, the system has pitted farmers against the railways with respect to securing individual fair shares of grain revenues. But with the removal of the single desk marketing and logistics function of the Canadian Wheat Board (CWB) in late 2012, a very interesting and potentially game-changing outcome is emerging with respect to the new functionality of the grain companies in the Canadian system. While historical awareness of rail s natural monopoly position in the grain handling system has kept that sector regulated (in several ways) for close to a century, we are now starting to see the effects of a less than competitive Canadian grain handling sector on revenue sharing, along with renewed movement in the industry with respect to buyouts and potential mergers. This overview will highlight some of the changes now occurring and how they are potentially going to interact or evolve as the system moves forward. For example, the on-going regulatory instrument used to regulate grain transportation rates in Canada (called the maximum revenue entitlement (MRE) or revenue cap) is under current debate because of the introduction a few months ago of a modification to an old regulatory instrument known as extended (or reciprocal) interswitching. As opposed to the revenue cap which is a direct intervention on monopoly behavior, extended interswitching is designed to encourage the major Canadian grain carriers to compete with one another and potentially seek out new traffic (Nolan and Skotheim, 2008). But the most intriguing aspect of extended interswitching is how it might allow a major rail carrier from the U.S. to solicit grain traffic in some areas of the Canadian grain transportation system.

The first section of this document is a letter to the federal Minister of Transport from the facilitator charged with the task of achieving consensus among various stakeholders & working groups on resolving issues related to implementation of a new system for handling & transporting western Canadian grain. The letter offers observations about issues on which divided views are set out in the stakeholder's report that forms the second section. The stakeholder's report begins with background on the western grain handling & transportation system, related government policies, regulatory reform, and the 1998 report by Justice Estey that made recommendations for a less-regulated, more accountable, and more competitive system. It then reviews the stakeholder process and the problems with the current system. Finally, it discusses issues relating to a revenue cap, tariff structure, railway competition & safeguards, branch line abandonment, producer-owned grain cars, the transportation role of the Canadian Wheat Board, and efficiency gains to producers. The annex includes a summary of Estey report recommendations. The remaining sections are reports from three working groups on rates & revenues, commercial relations, and railway competition & safeguards. The working group reports include discussion of relevant grain handling & transportation issues, comments on the Estey report recommendations, and their own recommendations for reform.

The objectives of this paper are to provide a framework for examining the widespread changes that will occur in the GHTS and to examine the impact of these changes on the operation of the system and the welfare of system partici- pants. [...] In par- ticular, this paper argues that policy makers need to pay attention to a lack of competition by both the railways and the grain companies, to the presence of externalities in the sourcing and handling of grain, and to the provision of key public goods on which the performance of the system rests. [...] The following list presents some of the major issues that have been raised regarding the impact of the removal of the CWB (some of these issues, for instance, were discussed in the recent Report of the Working Group on Marketing Freedom). [...] Questions of market power are clearly important - the viability of the CWB, the access of farmers to producer cars and short line railways, and the future of the rail cap are all examples of cases where the extent to which the market will be able to perform efficiently and effectively depends on the market power possessed by the railways and the grain companies.
