Excerpt: ... GROBBELAAR v. VAN HEERDEN. 1906. August 2, 27. Kotze, J.P., and Sheil, J. Safe.--Periculum ret venditae.--Delivery.--Cession of action.--Damages. A purchaser, who has neither obtained delivery nor taken cession of action from the vendor, cannot sue a third party for damage caused to the thing sold. Ostriches were sold, and before delivery by the seller to the purchaser some of them were plucked and damaged by a third party. Without obtaining cession of action from the seller, the purchaser sued the third party for and recovered damages. Held, on appeal, that as the dominium was not in the purchaser before delivery, he could not sue without cession of action from the vendor, and the judgment should have been one of absolution. Held, further, that this defence could be raised on appeal, though it had not been relied upon in the court below. Appeal from a decision of the Assistant Resident Magistrate of Cradock in an action in which the present respondent, the plaintiff in the court below, sued the defendant, the present appellant, for 20 damages. The summons claimed (a) the sum of 10, being the value of certain ostrich feathers belonging to the plaintiff, wrongfully and unlawfully plucked by the defendant from certain five ostriches, the property of the plaintiff, on or about the 11th May, 1906; and (b) the sum of 10, as and for damages caused by the deterioration in value of the said ostriches in consequence of the wrongful and unlawful plucking. The defendant pleaded the general issue. The assistant resident magistrate gave judgment in favour of the plaintiff on the first claim for 3, 14s., and on the second claim for 2, with costs.
