'Violence' is virtually synonymous in the popular imagination with the period of the Later Roman Empire-a time when waves of barbarian invaders combined with urban mobs and religious zealots to bring an end to centuries of peace and serenity. All of these images come together in the Visigothic sack of the city of Rome in A.D. 410, a date commonly used for the fall of the entire empire. But was this period in fact as violent as it has been portrayed? A new generation of scholars in the field of Late Antiquity has called into question the standard narrative, pointing to evidence of cultural continuity and peaceful interaction between "barbarians" and Romans, Christians and pagans. To assess the state of this question, the fifth biennial 'Shifting Frontiers' conference was devoted to the theme of 'Violence in Late Antiquity'. Conferees addressed aspects of this question from standpoints as diverse as archaeology and rhetoric, anthropology and economics. A selection of the papers then delivered have been prepared for the present volume, along with others commissioned for the purpose and a concluding essay by Martin Zimmerman, reflecting on the theme of the book. The four sections on Defining Violence, 'Legitimate' Violence, Violence and Rhetoric, and Religious Violence are each introduced by a theme essay from a leading scholar in the field. While offering no definitive answer to the question of violence in Late Antiquity, the papers in this volume aim to stimulate a fresh look at this age-old problem.

From September 394 to early January 395, seven monks from Rufinus of Aquileia's monastery on the Mount of Olives made a pilgrimage to Egypt to visit locally renowned monks and monastic communities. Shortly after their return to Jerusalem, one of the party, whose identity remains a mystery, wrote an engaging account of this trip. Although he cast it in the form of a first-person travelogue, it reads more like a book of miracles that depicts the great fourth-century Egyptian monks as prophets and apostles similar to those in the Bible. This work was composed in Greek, yet it is best known today as Historia monachorum in Aegypto (Inquiry about the Monks in Egypt), the title of the Latin translation of this work made by Rufinus, the pilgrim-monks' abbot. The Historia monachorum is one of the most fascinating, fantastical, and enigmatic pieces of literature to survive from the patristic period. In both its Greek original and Rufinus's Latin translation it was one of the most popular and widely disseminated works of monastic hagiography during Late Antiquity and the Middle Ages. Modern scholars value it not only for its intrinsic literary merits but also for its status, alongside Athanasius's Life of Antony, the Pachomian dossier, and other texts of this ilk, as one of the most important primary sources for monasticism in fourth-century Egypt. Rufinus's Historia monachorum is presented here in English translation in its entirety. The introduction and annotations situate the work in its literary, historical, religious, and theological contexts.

La presente monografía realiza un estudio desde el Derecho romano hasta el ordenamiento jurídico actual, de la preocupación en el tratamiento de los reclusos, así como de unos principios y reglas de régimen interno de la organización penitenciaria. En este trabajo de investigación, estructurado en cinco capítulos, el autor ha ido analizando los distintos problemas que se plantean en torno a la gestión y tratamiento de reclusos pero no desde la óptica de las penas per se, sino dentro de un desarrollo histórico jurídico administrativo y penitenciario de la sociedad romana. Desde una perspectiva descriptiva, en el capítulo I el autor ha destacado algunas referencias a la morfología y topografía carcelaria dentro y fuera del Foro poniendo de manifestó que las sedes carcelarias más antiguas fueron la cárcel Marmetina; otra cuestión a la que dedica parte de este capítulo es el estudio de numerosas fuentes que ponen de manifiesto la necesidad de habilitar otros edificios públicos como el templo de Saturno. En el capítulo II procede el autor al estudio del encarcelamiento y el tratamiento penitenciario desde la óptica del personal de la Administración carcelaria analizando figuras tan importantes como son: los tresviri capitales, los prefectos vigilum, custodia carceris, los carcerarii y los commentariensis. Dedica también este capítulo a las condiciones de encarcelamiento partiendo del análisis del conceptos tales como carcer y vincula. También, en este mismo capítulo, el autor estudia con profundidad y de manera pormenorizada la exégesis de las correspondientes fuentes sobre las condiciones de encarcelamiento. En el capítulo III el autor analiza las mejoras en las condiciones de encarcelamiento así como la impronta religiosa estudiando las condiciones de encierro a través de un estudio profundo del CTh 9.3.1 pr.; llegando a la conclusión en el estudio de esta fuente que la humanitas es un argumento recurrente en la legislación tardo imperial. Acaba el autor este capítulo III con un análisis exhaustivo de las Novelas (nuevas leyes)15.6.1 y 134.9.1. En el IV capítulo de este trabajo se aborda la proyección y desarrollo histórico más allá del Derecho romano; de ahí que el autor se haya preocupado por introducir, en este capítulo, las fuentes históricas del derecho español desde el Liber iudiciorum y las Partidas. Asismismo, ha realizado un estudio en profundidad de la impronta romana en la nueva y Novísima Recopilación demostrando la influencia del Derecho Romano en los principios y en el régimen penitenciario moderno. Finalmente, para terminar con este aspecto descriptivo, en el capítulo V el autor se adentra en la proyección postromana de la administración penitenciaria en Derecho Romano analizando las cuestiones más controvertidas que han sido objeto de estudio en este interesante trabajo, donde se han destacado como muchos principios del ordenamiento jurídico romano, en materia de administración penitenciaria, han superado el umbral de la codificación y llegando a la conclusión de que muchas normas de Derecho Positivo, principios y axiomas, en esta materia, ya eran conocidas en el ordenamiento jurídico romano.

Em regra, a história do direito penal é descurada em obras de seu campo. Manuais e tratados, habitualmente, dedicam-lhe tímidas linhas e principiam a abordagem por Roma ou, quando muito, pela Grécia, sem alusão às precedentes e às contemporâneas civilizações da Antiguidade. Por igual, produções literárias versando especificamente sobre história do direito penal são poucas e/ou incompletas.
