Este juvenil ensayo de 1960 era un trabajo escolar en el cual el autor abordó, desde su perspectiva de entonces, el conjunto de discursos del cónsul Marco Tulio Cicerón a fines del año 63 AEC para liquidar a su rival, Lucio Sergio Catilina, y a otros políticos con quienes se había enemistado. La temática inicial del escrito de mocedad viene retomada en una adjunta monografía histórico-jurídica titulada «Lucha de clases y quiebra de la legalidad constitucional en la Roma tardorrepublicana», escrita en 2019 e igualmente incluida en la presente publicación. Abórdanse en esa monografía los hechos de la presunta conjura catilinaria (que, según conjeturo, no pasaron de ser una de tantas intrigas electorales, asociada a movimientos sociales de protesta, a lo sumo sediciosos, pero no hechos de rebelión o subversión violenta). Viene luego abordado todo el transfondo histórico-jurídico de aquellos acaecimientos, para proponer, como clave explicativa, la lucha de clases (reconsiderada sin molde doctrinal o conceptual prefijado) y su impacto en el resquebrajamiento de la legalidad constitucional tardorrepublicana, desde la dictadura silana hasta la implantación del despotado augustano, que viene interpretado como régimen bonapartista. Particular atención se brinda a la relación entre esclavos y obreros libres en aquellas luchas de clases, al papel de la religión, a las instituciones jurídicas y políticas, al Senado, las elecciones, los tribunos de la plebe y la caracterización del régimen. Polemizo con Fergus Millar, refutando su tesis de que se trataba de una democracia. Pautas para el análisis jurídico-constitucional son la inexistencia de un canon de jerarquía normativa y el carácter esencialmente consuetudinario del sistema constitucional de la Roma de aquel período.
