The Committee on Foreign Investment in the United States (CFIUS) is comprised of nine members, two ex officio members, and other members as appointed by the President representing major departments and agencies within the federal executive branch. While the group generally has operated in relative obscurity, the proposed acquisition of commercial operations at six U.S. ports by Dubai Ports World in 2006 placed the group's operations under intense scrutiny by Members of Congress and the public. Prompted by this case, some Members of the 109th and 110th Congresses questioned the ability of Congress to exercise its oversight responsibilities given the general view that CFIUS's operations lack transparency. Other Members revisited concerns about the linkage between national security and the role of foreign investment in the U.S. economy. Some Members of Congress and others argued that the nation's security and economic concerns have changed since the September 11, 2001, terrorist attacks and that these concerns were not being reflected sufficiently in the Committee's deliberations. In addition, anecdotal evidence seemed to indicate that the CFIUS process was not market neutral. Instead, a CFIUS investigation of an investment transaction may have been perceived by some firms and by some in the financial markets as a negative factor that added to uncertainty and may have spurred firms to engage in behavior that may not have been optimal for the economy as a whole. On July 12, 2016, Senator Charles Grassley introduced S. 3161 to include the Secretary of Agriculture as a permanent member of the CFIUS and to include the national security impact of foreign investments on agricultural assets as part of the criteria the Committee uses in deciding to recommend that the President block a foreign acquisition.

In recent years, China, the US, and the EU and its Member States have either promulgated new national laws and regulations or drastically revised existing ones to exert more rigorous government control over inward foreign direct investment (FDI). Such government control pertains to the establishment of an ex-ante review regime of FDI in the host state in sectors that are considered as ‘sensitive’ or ‘strategic’, with an aim to mitigate the security-related implications. This book conducts a systematic and up-to-date comparative study of the national security review regimes of China, the US, and the EU, using Germany as an exampling Member State. It answers a central research question of how domestic law should be formulated to adequately protect national security of the host state whilst posing minimum negative impacts to the free flow of cross-border investment. In addition to analyzing the latest development of the national security review regimes in aforementioned jurisdictions and identifying their commonalities and disparities, this book establishes a normative framework regarding the design of a national security review regime in general and proposes specific legislative recommendations to further clarify the law. Technology is now the defining element of the Trump administration’s self-professed “strategic competition” with China. Washington is highly attuned to the long-term consequences and links between scientific progress, technological adaptation and national power in burgeoning US-China competition. Policymakers are attempting to balance efforts to maintain the open and global foundations of US and allied research and development systems, while deterring those that abuse its accessible and integrated nature. While President Donald Trump has been highly inconsistent on technological issues, Congress and the executive branch have slowly moved forward in executing the 2017 National Security Strategy and protecting what it termed the US National Security Innovation Base. Congress and the Trump administration have embarked on a ponderous — and at times heavy-handed — effort to protect America’s technological advantage across multiple domains and through actions by several branches of government. Congress has expanded the powers of the Committee of Foreign Investment to review non-controlling investments in technology companies. New export controls are being rolled out which feature vastly more expansive definitions of “foundational” and “emerging” technologies, broadening their scope and potential reach. The Department of Justice has launched a major criminal justice campaign labelled the “China Initiative”, with the goal of prosecuting technology theft and enforcing existing regulations in every US state. Draft bills indicate the likely expansion of Congressional reform to halting the flow of US government funds flowing to overseas partners also involved in joint high-tech research and development (R&D) with China, affecting third parties like Australia. Australia will be significantly affected by Washington’s unravelling of the US-China technological relationship, owing to its deep enmeshment with America’s scientific infrastructure. To navigate these changes in the national interest, Canberra must consider the following. Australia will face growing pressure to limit its science and technology interaction with China in critical dual-use fields in order to maintain technological collaboration with the United States in some emerging technologies, and may even be required to adopt restrictive export control policies. Australian research by universities, defence industry, business and government agencies will be seriously impacted by the United States’ expanded export control reform. Canberra should continue to lobby US policymakers on solutions, such as providing exemptions under the National Technology and Industrial Base framework. As the global technological ecosystem becomes more nationalised, securitised and difficult to navigate for industry and governments alike, Australia should implement a national research and development strategy that builds its own technological ‘counterweight.’

Relations between China and Israel have expanded rapidly since the early 2000s in numerous areas, including diplomacy, trade, investment, construction, educational partnerships, scientific cooperation, and tourism. Israel seeks to expand its diplomatic, economic, and strategic ties with the world's fastest-growing major economy and diversify its export markets and investments. China seeks Israel's advanced technology and values Israel's location as part of the Belt and Road Initiative. Chinese investments in Israel have grown substantially and include investments in high-tech companies that produce sensitive technologies as well as the construction and operation of key infrastructure projects. Chinese investment in sensitive technologies and construction of major Israeli infrastructure projects present distinct concerns for Israel and the United States. The authors examine the extent and nature of Chinese investments in Israeli technology and infrastructure and discuss the security implications these pose for Israel and the United States. The primary concern regarding investment relates to Chinese ownership of companies that might possess sensitive technology or data; concerns over construction are focused on the use of infrastructure projects to further Chinese foreign policy goals. The operation of infrastructure projects affords China unique surveillance opportunities and possibly economic and political levers of influence.
