This book takes a long-term view of environmental policy in Poland, which thus serves as an example to increase our understanding of environmental policy making in general in the former Eastern bloc countries. The perspective adopted also includes the pre-transition period, since the transformation process cannot be understood without reference to the preceding period. The book investigates the driving forces underlying policy changes, both prior to and after the transition, and identifies elements both of change and continuity - topics that have hitherto been neglected in the literature. A change of political system in Poland did not lead to a major change in the thrust of environmental policy: the policy makers adopted a cautious approach to new instruments and institutions during the transition period. What did change with the transition was the implementation aspect: the effectiveness of environmental policy increased dramatically after the abolition of socialism. The rule of law meant that the state administration and the polluters were subordinated to the legal system, thus increasing the power to environmental policy. When the Protocol on Environmental Protection to the Antarctic Treaty entered into force on 14 January 1998, a new phase commenced for the Antarctic Treaty System. EDOARDOCROCI IEFE - Università Bocconi, Milano, Italy Voluntary approaches in environmental policy represent a “third wave” of regulation in the environmental field. “Command and control” was the first wave. Its core is based on uniform emission standards, the respect of which needs to be enforced through extensive monitoring and severe sanctions. The expected cost of sanction for non-compliance, calculated as its amount multiplied for the probability to be caught, must be superior to the benefits of non-compliance, in order to let the sanction be effective. As the benefits of non-compliance can vary among firms, sanctions need to be very high in order to be effective. In fact sanctions are ordinary correlated to environmental damage and not to the benefits of non-compliance. But very high sanctions can be difficult to enforce as they appear unfair and can lead to dramatic consequences on firms and workers, up to shut-downs of plants. Ambient standards reduce these problems, but oblige the regulator to know a huge amount of information, regarding the specific contribution of each polluter to the polluted body. Information is difficult to obtain because of asymmetric information and costly to produce because it requires large and skilled regulating and enforcing organizations. Nevertheless complex regulation is the base of any environmental policy framework, as it allows the policy maker to fully exercise its power of composition of various interests in a relatively transparent way. Economic instruments were the second wave.

What is the role of government in environmental politics and policy? The answer to this question used to be relatively clear. Government was to regulate the environmental performance of state and non-state actors, to set standards, impose charges, and establish more or less stringent criteria of acceptable behavior. With the increasing appearance of the issues of globalization and global governance in the political science literature, however, the focus has turned to the role of non-state actors. Academic research and the popular debate have identified business, non-governmental organizations (NGOs), and civil society as such as increasingly important and potentially powerful actors in the political arena. At the same time, some observers have proclaimed the influence of government to be declining. Others have argued that the role of government primarily is changing rather than declining. Those who adopt the latter perspective postulate that the new role for government in this changing political and socio-economic context is to set the framework for action. In this perspective, government is still of fundamental importance for the functioning of the society, the economy, and political decision-making, but its role is different in that government 'merely' provides the institutional framework facilitating desired outcomes.

Waste management can be considered as a mirror of society. In its (our) fluctuating definition, besides conserving a supply of valuable materials and resources, it acts as a fascinating expression for our throw-away mentality. Waste is inevitable, but it nevertheless provides an opportunity, a need and an incentive for society to pursue a more careful management of it. If this is successfully carried out, society may well find it possible to manage itself in an overall more careful and universal way. The management, or governance, of radioactive waste particularly is determined by a complex constellation of individuals, social aggregates, and institutions. A wealth of interconnected parts forms a complex and volatile system that is highly technical and explosively political in nature. The problems inherent in this system must be managed so as to reach a safe, acceptable, responsible, feasible, and sustainable “solution”. It is a system with an objective long-term dimension, with a hazard potential of, in part, hundreds of thousands of years; and it has a long-term institutional dimension insofar as its implementation must last for decades. The very notion of risk extends from the long life of radionuclides, over the perception of dread to the decisional risk of whether, when and how to implement an agreed upon “solution”.

The book focuses on the negotiation process leading up to the creation of the Convention on Biodiversity (CBD) and the domestic implementation of this international agreement. This political science study of the negotiation process applies several perspectives drawn from international relations theories, while also focusing on the implementation of international environmental agreements in a developing country. Moreover, the links between factors at international and domestic levels are examined, with four proposed mechanisms through which an international institution may affect domestic policies.
