Changing Legal and Civic Culture in an Illiberal Democracy is a unique empirical study on recent developments in legal and civic consciousness in Hungary. Drawing its methodology from social psychology, this book illuminates a shift in legal consciousness during the time in which Orbán’s government has cemented Hungary’s reputation as an illiberal democracy. The book foregrounds the voices of the Hungarian population in how they view the shift towards increasingly right-wing politics and an erosion of the rule of law. It opens with an extensive theoretical introduction of the historical development and psychological dimensions of legal consciousness in Hungary and relates the Hungarian research to international developments. It then presents its empirical results and offers a jargon-free account of ordinary people’s changing perceptions of their relationship to Hungary’s civic and legal cultures, before finally examining the correlations between surveys. Methodologically, the book establishes that theories of legal consciousness and social change are bolstered by empirical data. This book shows the rise and morphology of a self-identified `illiberal democracy’, the first 21st century illiberal political regime arising in the European Union. Since 2010, Viktor Orbán’s governments in Hungary have convincingly offered an anti-modernist and anti-cosmopolitan/anti-European Unionist rhetoric, discourse and constitutional identity to challenge neo-liberal democracy. The Hungarian case provides unique observation points for students of transitology, especially those who are interested in states which are to abandon pathways of liberal democracy. The author demonstrates how illiberalism is present both in `how’ and `what’ is being done: the style, format and procedure of legislation; as well as the substance: the dismantling of institutional rule of law guarantees and the weakening of checks and balances. Their analyses draw on a unique set of data collected and processed by the contributors to this volume within the framework of the World Values Survey project. This data enables these authors to establish similarities and differences in support of democracy between a large number of countries with different cultural and structural conditions as well as historical legacies. The macro-level findings of the book tend to support the proposition that support of democracy declines the further east one goes. In contrast, micro-level relationships have been found to be astonishingly similar. For example, support of democracy is always positively related to higher levels of education – no matter where an individual citizen happens to live. Populist Authoritarianism focuses on the Chinese Communist Party, which governs the world's largest population in a single-party authoritarian state. Wenfang Tang attempts to explain the seemingly contradictory trends of the increasing number of protests on the one hand, and the results of public opinion surveys that consistently show strong government support on the other hand. The book points to the continuity from the CCP's revolutionary experiences to its current governing style, even though China has changed in many ways on the surface in the post-Mao era. The book proposes a theoretical framework of Populist Authoritarianism with six key elements, including the Mass Line ideology, accumulation of social capital, public political activism and contentious politics, a hyper-responsive government, weak political and civil institutions, and a high level of regime trust. These traits of Populist Authoritarianism are supported by empirical evidence drawn from multiple public opinion surveys conducted from 1987 to 2015. Although the CCP currently enjoys strong public support, such a system is inherently vulnerable due to its institutional deficiency. Public opinion can swing violently due to policy failure and the up and down of a leader or an elite faction. The drastic change of public opinion cannot be filtered through political institutions such as elections and the rule of law, creating system-wide political earthquakes.
