This volume examines, from a number of different perspectives, the implications of the UN Convention on the Rights of the Child, for justice for children. The contributors are drawn from a cross-section of the community of individuals with an interest in or responsibility for children: academics, practitioners, policy makers and researchers. It therefore blends the academic with the practical and has immediate relevance for those researchers, lawyers, academics, fieldworkers and policy makers whose concern is children's rights. Justice for Children is based on proceedings of the International Conference on Justice for Children, held in Glasgow, September 1992

Children's rights have gained greater global visibility through the almost universal ratification of the United Nations Convention on the Rights of the Child. Treaty bodies for other international and regional instruments, which cover the rights of "everyone", including children, are giving increasing attention to children's rights. In the same vein, human rights mechanisms, including regional ones such as the European Court of Human Rights, the European Committee of Social Rights and the Inter-American Commission and Court, have become more sensitive to children's rights. With this increasing visibility comes the recognition that children in every country of the world suffer widespread and often severe breaches of the full range of their rights - civil, political, economic, social and cultural. In many cases, children do not have adequate or realistic remedies for breaches of their rights at national level. Seeking remedy through international and regional human rights mechanisms, though on the increase, is not well-developed. International justice for children discusses the principles of child-friendly justice at international level and examines monitoring mechanisms and current systems of admissibility, determining how easy or difficult it is for children to gain access to them. This publication also identifies the obstacles to be overcome and proposes concrete ways to remove them through specific recommendations to governments, international organizations and monitoring bodies.--Publisher's description.

Youth Justice And Child Protection written by Malcolm Hill and has been published by Jessica Kingsley Publishers this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007 with Social Science categories.

This book is an examination of recent developments in the areas of youth justice and child protection. It investigates how well young people and the societies in which they live are served by judicial and service systems. Consideration is given to those in care - in young offenders' institutions, foster families and residential homes - as well as those living with their families. A broad range of international experts discuss the largely segregated youth justice and children's legal and service systems in England and Wales, other parts of Western Europe and the US, and compare these with Scotland's integrated system. The implications of these arrangements are considered for the rights of children and parents on the one hand and society on the other. The contributors also provide insights into the rationale for current and proposed policies, as well as the efficacy of different systems. This book will be an important reference for policy-makers, social workers, lawyers, magistrates and equivalent decision makers, health professionals, carers, and all those working in youth justice and child protection. It is highly relevant for academics and students interested in children, citizenship, youth crime, child welfare and state-family relations.

Children who come into conflict with the law are more likely to have experienced violence or adversity than their non-offending peers. Exacerbating the deleterious effects of this childhood trauma, children’s contact with the criminal justice system poses undue risks of physical, sexual, and psychological violence. This book examines the specific forms of violence that children experience through their contact with the criminal justice system. Comprising contributions from leading scholars and practitioners in children’s rights and youth justice, this book profiles evidence-based prevention strategies and case studies from around the world. It illustrates the diversity of contexts in which various forms of violence against children unfold and advances knowledge about both the nature and extent of violence against children in criminal justice settings, and the specific situational factors that contribute to, or inhibit, the successful implementation of violence prevention strategies. It demonstrates that specialised child justice systems, in which children’s rights are upheld, are crucial in preventing the violence inherent to conventional criminal justice regimes. Written in a clear and accessible style, this book will be of interest to students and researchers engaged in studies of criminology and criminal justice, youth justice, victimology, crime prevention, and children’s rights.

Child-friendly Justice assesses how the UN Convention on the Rights of the Child has affected the development of child law and the promotion of children’s rights in the past twenty-five years. Its 24 studies probe a broad variety of issues relating to children’ s contact with civil, administrative and criminal justice systems, the protection of child integrity and their right to participation, information and proper representation. The contributors - all experts on child-related matters - represent international organisations, academia and NGOs. They provide a clear picture of the origins of the current problems in realising child-friendly justice, and they discuss possible solutions.

Child Victims And Restorative Justice written by Tali Gal and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-07-11 with Political Science categories.

Children are the group most likely to be victimized yet least likely to report the crimes against them. Because of their unique vulnerability, an elaborate set of protections tries to secure their safety at home, in school, and in the community, yet they often experience further trauma inside the very criminal justice system designed to punish those who harm them. Such a system can leave child victims without emotional healing and a sense of justice because it does not consider the full scope of their wishes, interests, and rights. This failure can be attributed to the system's tendency to view children as objects of protection instead of legitimate rights-holders.Here, using a nuanced, multi-dimensional theory of children's interrelated rights and needs vis a vis victimization, Tali Gal presents an innovative restorative justice model for repairing harms and rebuilding relationships in the wake of crimes against children. It validates empirically documented children's needs--such as telling their stories, asking questions, and a sense of autonomy and control over the proceedings--and holds their associated and often-overlooked rights--such as rehabilitation and their overarching best interests-paramount. The rich theoretical underpinnings of the book are vividly illustrated by examples of successful restorative justice programs involving children (including the highly controversial inclusion of child victims of sexual assault). In addition, a set of eight heuristics provides a convenient reference for restorative justice programs to ensure that they safeguard the full range of child victims' needs and rights at all times. With its unique human-rights perspective on the study of childhood victimization and an innovative, child-inclusive restorative justice model, this book promises to be a touchstone for practitioners, policymakers, and researchers concerned with children's well-being in the aftermath of crime and violence.
