This volume examines, from a number of different perspectives, the implications of the UN Convention on the Rights of the Child, for justice for children. The contributors are drawn from a cross-section of the community of individuals with an interest in or responsibility for children: academics, practitioners, policy makers and researchers. It therefore blends the academic with the practical and has immediate relevance for those researchers, lawyers, academics, fieldworkers and policy makers whose concern is children's rights. Justice for Children is based on proceedings of the International Conference on Justice for Children, held in Glasgow, September 1992

Can justice be achieved in voluntary cases - or is it purely a matter for courts to determine? Using a multi-disciplinary framework, which has at its centre a philosophical/anthropological view of social work as a moral practice, the author explores the notion of justice in public child care. The problem of parents’ and children’s rights is addressed, first of all in the legal context of care proceedings and then in the social work setting of voluntary care. Forty-six difficult cases are examined to see how decisions are made and implemented. In the final analysis the dimensions of social and legal justice are charted in a way which may contribute to general understanding of these issues and some suggestions are offered about how social work may move forward in response to legitimate criticism.

This book is an examination of recent developments in the areas of youth justice and child protection. It investigates how well young people and the societies in which they live are served by judicial and service systems. Consideration is given to those in care - in young offenders' institutions, foster families and residential homes - as well as those living with their families. A broad range of international experts discuss the largely segregated youth justice and children's legal and service systems in England and Wales, other parts of Western Europe and the US, and compare these with Scotland's integrated system. The implications of these arrangements are considered for the rights of children and parents on the one hand and society on the other. The contributors also provide insights into the rationale for current and proposed policies, as well as the efficacy of different systems. This book will be an important reference for policy-makers, social workers, lawyers, magistrates and equivalent decision makers, health professionals, carers, and all those working in youth justice and child protection. It is highly relevant for academics and students interested in children, citizenship, youth crime, child welfare and state-family relations.

Children's rights have gained greater global visibility through the almost universal ratification of the United Nations Convention on the Rights of the Child. Treaty bodies for other international and regional instruments, which cover the rights of "everyone", including children, are giving increasing attention to children's rights. In the same vein, human rights mechanisms, including regional ones such as the European Court of Human Rights, the European Committee of Social Rights and the Inter-American Commission and Court, have become more sensitive to children's rights. With this increasing visibility comes the recognition that children in every country of the world suffer widespread and often severe breaches of the full range of their rights - civil, political, economic, social and cultural. In many cases, children do not have adequate or realistic remedies for breaches of their rights at national level. Seeking remedy through international and regional human rights mechanisms, though on the increase, is not well-developed. International justice for children discusses the principles of child-friendly justice at international level and examines monitoring mechanisms and current systems of admissibility, determining how easy or difficult it is for children to gain access to them. This publication also identifies the obstacles to be overcome and proposes concrete ways to remove them through specific recommendations to governments, international organizations and monitoring bodies.--Publisher's description.

"The goal of a social justice approach for children is 'to ensure that children, defined by the Convention on the Rights of the Child as all persons under the age of eighteen, are better served and protected by justice systems, including the security and social welfare sectors' (United Nations, 2008). Despite this worthy goal, the United Nations (UN) documents how children are rarely viewed as stakeholders in justice rules of law; child justice issues are often dealt as separate from larger justice and security issues; and when justice issues for children are addressed, it is often through a siloed, rather than a comprehensive, approach. The UN concludes: 'Access to justice, though increasingly recognized as an important strategy for protecting the rights of vulnerable groups, and thus for fighting poverty, rarely takes children into account' (United Nations Secretary General [UNSG], 2008)"--

This Training Manual aims to provide justice practitioners with an accessible guide to dealing with issues relating to children alleged to have committed terrorism-related offences. It reviews some of the common challenges encountered at different stages of the justice process and offers guidance based on international law, standards and promising practices. It is part of a series of three manuals and is designed to complement the UNODC Handbook Children Recruited and Exploited by Terrorist and Violent Extremist Groups: The Role of the Justice System. The UNODC Handbook provides guidance for a comprehensive approach to the treatment of these children, from prevention to reintegration. Such guidance is anchored in the analysis of the international legal framework, and in the identification of relevant promising practices across different regions of the world.
