Studienarbeit aus dem Jahr 2012 im Fachbereich Orientalistik / Sinologie - Chinesisch / China, Note: 1,3, Freie Universität Berlin (Ostasiatisches Seminar), Veranstaltung: Paradigmen der Chinaforschung, Sprache: Deutsch, Abstract: „Man bedenke, dass die Sinologie sowohl die Kenntnis des Altertums, als auch durch diese die der Gegenwart vermitteln soll.“ (Otto Franke) Obwohl dieses Zitat des deutschen Sinologen Otto Franke bereits aus dem Jahre 1911 stammt, ist seine scheinbare zeitlose Aussagekraft bis heute eines der zentralen Spannungsfelder, in denen sich die gegenwärtige Sinologie bewegt. Schließlich inkludiert Frankes Aussage nicht nur das Erschließen und Bewahren interessanter Bestandteile der Menschheitsgeschichte, sondern gleichzeitig umfasst seine Definition ebenso die chinesische Gegenwart, welche durch die sinologische Erforschung des Altertums erkannt und erklärt werden soll.1 Kurz gesagt geht es darum, mit Hilfe der in jahrhundertealter Tradition aufgezeichneten kulturellen Errungenschaften Chinas die aktuellen dortigen sozialen, politischen, geistigen und nicht zuletzt ökonomischen Verhältnisse verstehen und veranschaulichen zu können. Die entscheidende Frage dabei ist allerdings, mit welchen Inhalten, Paradigmen, Werten und Mitteln diese sinologische Wissensvermittlung in Deutschland stattfinden soll. Zwar ist diese Frage beinahe genauso alt wie das Betätigungsfeld der Sinologie selber, nichtsdestotrotz ist eine finale, allgemeingültige und zugleich umfassende Beantwortung dieser Frage im wissenschaftlichen Diskurs noch lange nicht in Sicht. Aus diesem Grund setzt sich die vorliegende Hausarbeit mit aktuellen Kritikpunkten und Problemen der deutschen Sinologie, aber auch mit ihren Chancen sowie vieldiskutierten Lösungsansätzen zur Bewältigung der zuvor dargelegten Problematiken auseinander.

Begleitet werden sie von Degenfelds Faktotum Gottfried von Bouillon und einem riesigen Neufundl�nder, der immer Degenfelds Bierglas in der Schnauze tr�gt. Auf der Reise schlie�en sich ihnen auch der dicke Holl�nder Mijnheer Willem van Aardappelenbosch und der Kapit�n Heimdall Turnerstick an, der behauptet, er k�nne perfekt chinesisch sprechen, indem er an alle Worte einfach die Endungen -eng, -ing, -ong, -ung anh�ngt und sich wundert, dass er nicht verstanden wird. Nach vielerlei Abenteuern (Piraten�berfall, Aufdeckung eines Tempelraubes und mehr) wendet sich alles zum Guten und der Blaurote Methusalem h�lt zusammen mit seinen Freunden, dem inzwischen gesundeten Onkel, der verschollenen Familie des Teeh�ndlers und deren Schatz triumphalen Einzug in die Heimatstadt.

The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.
