China's economic activities are having a clear and direct impact on the lives of average Americans. This impact is evident in the rise of Chinese investment in advanced sectors of the U.S. economy, including semiconductors and biotech, even as the Chinese government continues to restrict the ability of U.S. companies to invest in the same sectors, raising serious concerns for U.S. economic interests and national security. As the Trump administration prepares to formulate policy towards China, it is important to separate fact from fiction in the discussion of the key drivers and impacts of China's economic activities in the United States. According to data from the Rhodium Group, Chinese investment flows to the United States have grown steadily in recent years, reaching nearly $46 billion in 2016, a threefold increase from 2015. The speed of this investment flow growth coupled with a lack of reliable government data, both in China and the United States, has hindered efforts to accurately analyze trends in Chinese investment while also masking some of the risks and benefits these investments present to the United States. Even with limited official information, however, it is clear that Chinese investment is targeting sectors of strategic importance to the United States economy.

Highly publicized deals, such as Shuanghui Group's $4.72 billion acquisition of Smithfield Group in 2013 and Lenovo's $2.95 billion acquisition of Motorola Mobility in 2014, can obscure the bigger picture. Smaller transactions are less consequential for the national economy, yet may exert a tangible impact on states and local communities. Investment patterns are determined to a large degree by China's economic policies and corporate strategies. Viewing Chinese investment from this broader perspective helps shed light on other important issues, such as Chinese purchases of U.S. homes, the granting of EB-5 visas, and bilateral research exchanges.

US policy expressly welcomes Chinese investment, and since 2000 Chinese companies have invested nearly $50 billion in the United States. Notwithstanding those facts, the US regulatory environment for Chinese investment - at least with respect to the national security reviews of certain proposed transactions - has been criticized as politicized and protectionist. This article analyzes the experience of Chinese investors in the United States, particularly with respect to national security reviews led by the Committee on Foreign Investment in the United States (CFIUS). This article addresses a small, but significant, group of controversial US transactions involving Chinese acquirers, including CNOOC, Tangshan, Northwest, Huawei, and Ralls, which have had a damaging impact on Chinese perceptions of the US investment environment, and identifies key trends with respect to the US regulatory environment for foreign investment generally. The need for some $8 trillion in investment over the next 15 years to modernise US infrastructure should provide many opportunities for the US Government to further demonstrate that foreign investment - and in particular, Chinese investment - is indeed welcome in the United States.

Today's hearing will examine three aspects of China's economic policy. The first is China's state-owned or state-controlled companies and industries, which together constitute an estimated 30 to 40 percent of China's economy. These companies, generally the largest ones in China, are operated and managed by the central government of the People's Republic. They are an instrument of state power as well as the centerpiece of China's industrial policy. They receive massive government subsidies and are protected from competition from foreign companies. But, we also need to understand what other Chinese entities are doing - not a simple task. Beyond the state-owned or state-invested enterprises, there are companies that act under the direction of the state or with delegated authority. We need to understand the implications of their efforts. Two separate panels will examine U.S. direct investment in China and Chinese direct investment in the United States. Both forms of investment have been increasing, especially U.S. investment in China. As you will hear, more than half of the imports to the United States are from foreign invested enterprises in China.
